Drug House Shut Down

Janesville, WI: (Mar-21-08) The city brought charges against Lynn A. Johnston, the primary resident and acting landlord of a drug house, and Evelyn M. Garrity, owner of the property, alleging that the house was a public nuisance. The suit, filed in October 2007, claimed that the house endangered the comfort, health and safety of the public. The city's lawsuit detailed several drug-related incidents between February 2003 and July 2007 at the house at 1213 Birchwood Drive and petitioned the court to declare the house a public nuisance.

The suit stated that the Walworth County sheriff's deputies executed a search warrant at the house Feb. 7, 2003, and found marijuana, heroin, powder cocaine, crack cocaine, drug paraphernalia and $235 cash. Following that, Delavan police responded to a theft complaint at the house Jun. 1, 2004. Investigations showed the presence of prescription drugs and empty prescription bottles. Several following searches turned up evidence of huge quantities of marijuana.
