Patent Infringement

Dallas, TX: (Mar-20-08) Heely's Inc, a Dallas, TX, based company known for its wheeled footwear for youth, brought charges against Elan-Polo Inc., alleging patent and trademark infringement. Sources close to the case stated that the parties had reached a settlement agreement in the case, resolving the dispute. Under the terms of the deal, Elan-Polo agreed to pay Heely's Inc. $1.4 million, settling allegations of patent and trademark infringement.

Heelys also has signed a strategic licensing agreement with Elan-Polo, granting the St. Louis, MO, based footwear importer the rights to produce and sell a certain style of shoe skates with non-removable wheels both in the heel and in front of the heel. Elan-Polo is authorized to sell these shoes to an approved list of retailers in the United States and Canada, in return for royalty payments. The licensing agreement runs until 2011. Sources at Heelys said that the agreement offers Heelys better control over the marketplace while still maintaining its integrity and brand positioning.
