Jail Contract

This is a settlement for the Commercial lawsuit.

Beaumont, TX: (Feb-23-08) Jefferson County and the city of Port Arthur have been embroiled in a long standing legal dispute over an existing jail usage contract between the two entities. Officials stated that both filed court cases to determine how much the city owes for use of the county jail. Records show that Jefferson County cities have utilized the county jail since 1991, and with the exception of Port Arthur, all entered into new contract in 2004. The county has billed Port Arthur for $336,983 for fiscal years 2005 through 2008.

As part of a settlement reached, the parties agreed to resolve litigation after Port Arthur agreed to pay 75% of the arrearage owed for city prisoners who were incarcerated in the Jefferson County Correctional Facility and charged with Class A and B misdemeanor or some felonies. The case was expected to be heard in mid 2008, but with this action the case will be dismissed. As part of the terms of agreement, Port Arthur will also enter into a new jail contract with the county that is much like that of other Jefferson County cities including Beaumont, Nederland, Port Neches and Groves. In the new contract, Port Arthur will pay $52 per day for city prisoners. The city will be required to pay $252,737 for the back pay while other Jefferson County cities will receive a one-time 25% credit. Beaumont will be credited $260,327; Nederland $5,548, Port Neches $6,968, and Groves $13,042. [PORT ARTHUR NEWS: HOUSING INMATES]
