Eminent Domain

Glassboro, NJ: (Feb-4-08) Suleiman Arifi, 77, a Glassboro resident, brought a lawsuit against the borough over an eminent domain dispute involving a three-unit building at 213 W. High St. The suit stated that Glassboro took the property by eminent domain in March 2007. The disputed building, which is in Glassboro's Central Business District redevelopment zone, provided a home for Arifi and his wife and also generated $32,000 in annual income.

The parties reached a settlement agreement, resolving the lawsuit. Under the deal, Arifi, who has received public support in his fight with the borough, agreed to accept $250,000 as part an out-of-court arbitration. The agreed upon settlement figure is nearly $100,000 higher than the last borough offer during the weeks leading up to the final deal. Arifi, a naturalized American citizen who was born in Eastern Europe wanted a American court decision that reflected the county's justice system. The borough plans to sell the building to Arifi's former tenant, businesswoman Jennifer Stachiotti, owner of Turning Heads Salon, which occupies the building's first floor.
