Water Pumping Fee

Pajaro Valley, CA: (Jan-29-08) Several plaintiffs brought charges against the Pajaro Valley Water Management Agency, alleging that it illegally collected pumping fees from residents. Officials claimed that the agency had faced a string of lawsuits stretching back several years, over the long-standing problem of groundwater overdraft in the Pajaro Valley.

As part of a recent settlement reached, the Pajaro Valley Water Management Agency has agreed to pay back an estimated $13.5 million in illegally collected pumping fees under a tentative deal. The settlement comes in the wake of an appeals court ruling that so-called "augmentation fees" were illegally imposed by the agency. Records show that the state Supreme Court refused to review the ruling in September 2007, and the agency board subsequently slashed the $160 per acre foot of water pumping fee to comply with the decision.
