Police Brutality

Baton Rouge, LA: (Jan-28-08) Daniel Moody of Sabinal, TX, brought a lawsuit against the Sorrento Police Department, alleging that police used brutality and excessive force on him in May 2004. Records show that the suit, filed in September 2004, named the police department and former officer Andre Cavalier as defendants.Moody was a designated driver and chaperone for a group of high school students who had recently graduated; he accompanied the students to a home in Sorrento. A neighbor made a loud music complaint to the Police Department and Cavalier was sent to the home to investigate. Moody apologized for the loud music and told the officer the students would turn down the music. Witnesses said Cavalier, who was not provoked, screamed at the students, sprayed Moody with pepper spray and beat him with a nightstick. Moody was arrested by Cavalier and booked with disturbing the peace by intoxication, battery on a police officer and resisting arrest.

Sources said that Cavalier left the Sorrento Police Department three years ago and is now a detective with the Westwego Police Department. As part of a settlement reached, the 54-year-old Texas man recently received a $275,000 payout, resolving the federal lawsuit. Sources stated that following the settlement, both parties jointly dismissed the suit. [KACT NEWS: POLICE BRUTALITY]
