Sewer Easements
Fayetteville, AR: (Jan-10-08) A Fayetteville landowner brought charges against the city, over the value placed on the 112 Drive-In, land that was slotted for construction and sewer easements. Sources stated that nearly $800,000 separated the values placed on the land for construction and sewer easements that would complete the largest and longest of the sewer mains needed for the West Side Treatment Plant. The city's appraisal valued the land at about $36,000, while the owner's initial appraisal valued it at about $825,000. The landowner filed suit, seeking an additional $335,600. City officials stated that the city has been in negotiation for the construction and sewer easement since 2005 and has been using a temporary construction easement for more than a year and a half.
Placement of the easement for the sewer line, which will angle across the land, was complicated by the need to stay away from Clabber Creek in order to avoid endangering the Arkansas darter, a species of small perch.
