Excessive Force

Corpus Christi, TX: (Dec-10-07) Ruben Galvan, a Corpus Christi man, brought charges against the city, claiming that police used excessive force and violated his constitutional rights during his 2005 arrest outside a downtown nightclub. The suit, filed in March 2007, alleged that two Corpus Christi police officers, David Mihalco and Sergio Delgado, harassed and falsely arrested him on January 10, 2005 while, he was talking to his wife outside Club One on North Chaparral Street. Galvan stated in his suit that he tried to walk away after Mihalco began using obscenities and derogatory comments toward him but was forced to the ground and handcuffed by both officers. The city's legal defense stated that it was Galvan, not the two officers, who used profanity toward his wife and police and then became aggressive with the officers. As part of a settlement reached, the city agreed to pay Galvan $50,000 to resolve the lawsuit. In exchange, Galvan agreed to dismiss the lawsuit.
