Sinus Infection

Pittsburgh, PA: Lynn and James Flaherty, of Bethel Park, were awarded a $3 million judgment, following a jury trial before Allegheny County Common Pleas Judge Jeffrey A. Manning.

Lynn and James Flaherty were awarded the judgment, after Mrs. Flaherty's sinus infection was misdiagnosed resulting in complications that left her unable to regulate her emotions and/or perform complex cognitive functions.

$2 million was awarded to Mrs. Flaherty for pain & suffering, and to cover medical expenses. The other $1 million went to her husband, for loss of consortium (the inability of one's spouse to have normal marital relations).

The defendants in the case, Dr. Lesley DeGiovanni, Dr. John Montini and their physician's assistant, Kellie Egidi, plan to appeal.

According to the November 24, 2007 issue of the Pittsburgh Post-Gazette, Lynn Flaherty visited her family doctor's office in 2001 complaining of headaches and nasal discharge. She was seen by physician's assistant, Kellie Egidi, who instead of correctly diagnosing Mrs. Flaherty with a Sinus Infection, prescribed steroids, told her to undergo additional testing and return in a week.

Experts testified that the steroids without an antibiotic masked and exacerbated the infection. Five days later, she developed stroke-like symptoms, including facial drooping and disorientation, said one of her attorneys, Stephen Del Sole.

Following an emergency brain surgery, to remove part of her skull, Mrs. Flaherty, went into respiratory failure, had to be placed on a ventilator and later had to have a follow-up surgery. Her skull has since been replaced by plastic.

According to her attorney, Mrs. Flaherty lost all peripheral vision on her left side, has balance problems and has a nerve injury in her right leg. She has gone through rehabilitation to learn how to walk again and regain the skills to function in daily life. To date, Mrs. Flaherty has not been able to return to her job as a real estate agent.

According to the November 24, 2007 issue of the Pittsburgh Post-Gazette, particularly damaging to the defendant's case were documents submitted with the state, by Drs. DeGiovanni and Dr. Montini, stating that they would see every patient treated by Ms. Egidi.
