House Lien

Roseland, IN: (Nov-07-07) Cheryl Engel of Elkhart brought a lawsuit against the town, alleging that she was unable to sell her house because of code violations. Engel filed the suit in 2006 after potential buyers of a house she owns on West Willow backed out of the deal when about $98,000 in liens were found for alleged code violations. As part of a settlement reached, the Roseland Town Council approved of paying Elkhart $50,000 to resolve her lawsuit against the town. Sources stated that the issuance of the check was the final step to comply with a court order issued in an action the town had filed before St. Joseph Superior Court Judge Michael Scopelitis.
