House Raid

Kauai, HI: (Oct-24-07) A couple brought a lawsuit against the city and its police department after their home was mistaken for a drug dealer's residence, and wrongfully searched. Police records state that police had been tracking a package that allegedly contained 11 pounds of marijuana that had been picked up at the Koloa post office by a man who was driving a Toyota truck on March 15, 2005. Though police followed the car onto Kaumuali'i Highway and onto a private road with seven houses, when the transmitter inside the box went off indicating the package had been opened, police had lost visual contact with the vehicle. That led to them mistaking the home of William and Sharon McCulley, and entering without a warrant. The suit said that the police also committed assault and battery, trespassing, and negligently inflicted serious emotional distress upon the McCulleys, who were baby sitting their grandchildren at the time. As part of a settlement reached, the city awarded the McCulleys $325,000, resolving the lawsuit. [HAUAI GARDEN ISLAND NEWS: HOUSE RAID]
