City Building Access

Calistoga, CA: (Oct-04-07) Jeff Stivers, a Calistoga city resident, brought a lawsuit against the city, alleging that a number of the city's buildings violated the Americans with Disabilities Act (ADA). The Act had provisions calling for easy public access for disabled individuals. The lawsuit was filed in 2006 in Sonoma County courts against the city and Napa County.

As part of a settlement reached with the city, Stivers will receive $30,000. Further, the city agreed to pay Stivers' $43,000 legal fees. The city's insurance carriers will cover almost $41,000 of the total cost. City officials claimed that the costs for the improvements such as ADA-compliant parking spaces, making restrooms easier to access and designing ramps or other items to make entrance easier to the buildings are estimated at $30,000 to $50,000. The lawsuit will ensure that that some Calistoga city buildings will have better public access and be ADA complaint as well. [NAPA VALLEY REGISTER: ADA VIOLATIONS]
