Charleston, WV: (Aug-16-07) Nicole and Jeffery Rank of Corpus Christi, Texas, brought a lawsuit against the federal government after they were arrested at a July 4, 2004, rally at the state capitol, after refusing to cover T-shirts that bore anti-President Bush slogans. The suit claimed that the arrest was a violation of the First Amendment. Nicole and Jeffery Rank were handcuffed and removed from the rally, where Bush gave a speech. A judge dismissed trespassing charges against them, and an order closing the case was filed in US District Court in Charleston.
In a settlement reached, the federal government agreed to pay the couple $80,000. The American Civil Liberties Union backed Rank's stance claiming that the victory was not just Ranks but the First Amendment's, and that as a result of this lawsuit, public officials will think twice before they eject peaceful protesters from public events for exercising their right to dissent.
