Hi-Tech Pharmacal Co.

Washington, DC :(May-29-07) Medpointe Pharmaceuticals filed patent infringement charges against drug developer Hi-Tech Pharmacal Co., alleging that the company was distributing a generic version of a cold medication made by Medpointe Pharmaceuticals. Medpointe brought the lawsuit against Hi-Tech after it launched a generic version of Tussi-12, which treats cold and allergy symptoms. Under the settlement agreement, Medpointe will give Hi-Tech rights to its Vosol medications, which are used to treat ear infections. In a settlement reached, Hi-Tech Pharmacal agreed to stop distributing the cold medication made by Medpointe Pharmaceuticals and will pay the company $2.5 million to settle charges of patent infringement.
