Dallas, TX: With gasoline prices hitting record highs, Bio Performance aggressively marketed their green pills as a wonder-cure, repeatedly and falsely claiming that its fuel pills could improve vehicular fuel efficiency by as much as 30 percent while also reducing engine emissions by 50 percent. In May 2006, the Attorney General filed a lawsuit against Bio Performance that accused the company of violating the Texas Deceptive Trade Practices Act after CBS 11 tested the so-called, "magic gas pill", and found that they contained naphthalene - essentially mothballs. The Texas Attorney General's Office came to the same conclusion.

Despite the settlement with the state, Bio Performance founders say they aren't giving up their fight claiming that despite lab results proving otherwise, their pills have been tested to improve fuel efficiency. A final settlement requires that the Irving-based company Bio Performance return more than $7 million to its customers. Attorney General Greg Abbott announced a settlement with Bio Performance and its owners, Lowell Mims and Gustavo Romero that prevents the defendants from continuing to deceptively market their products and ends the state's eight-month legal action against the company.
