City of Wilkes-Barre

In December 2004, city fire Chief James Delaney Jr. brought forward a suit alleging that his demotion to captain earlier that year was politically motivated. Delaney claimed that his demotion was a direct result of his support for the former mayor of Wilkes-Barre, Tom McGroarty, who was defeated by Tom Leighton in the 2003 Democratic primary election. Delaney asserts that he was demoted the day Leighton was sworn in to his new position and that Pennsylvania state law prohibited him from being demoted to a rank below his previous position.

On April 3, 2006, a U.S. District Court Judge approved a $35,000 settlement in Delaney's favor. Further details about the settlement are not being disclosed. (Apr-15-06) [CITIZENS VOICE]
