Sunoco filed a lawsuit against the insurance provider regarding coverage for dozens of pending lawsuits over alleged groundwater contamination caused by methyl tertiary butyl ether, a gasoline additive manufactured by Sunoco. The lawsuits against Sunoco alleged MTBE was defectively designed and constituted a dangerous product, and that Sunoco breached a duty to warn of its dangers. A Senior U.S. District Judge ruled that Illinois National Insurance Co. must pay Sunoco $50 million in insurance coverage for their own pending lawsuits. (Sep-01-05) [LAW.COM]
