Ms. Di Fingleton retaliated against a witness when she threatened to demote the coordinate magistrate for Beenleigh, Basil Gribbin. Fingleton was convicted and spent six months in jail. However, the High Court overturned her conviction after finding she should never have been charged; the threat was a legal exercise of administrative power protected by section 10(2) of the Magistrates Act. Fingleton has been offered the position of magistrate at the Caloundra Courthouse in southeast Queensland and has been awarded a $475,000 settlement. (Sep-01-05) [COURIER MAIL]
