Zimmer NexGen Sues Attorneys over Trademarks, Alleged False Claims

Warsaw, INZimmer Inc., the maker of the NexGen knee replacement implants, recently filed a lawsuit to stop a law firm from making alleged false claims about the company and using its trademarks on Web sites.

span itemprop="image" itemscope itemtype="https://schema.org/ImageObject" style="display:block">The Indianapolis Business Journal reports that the law firm published on its Web site the results of a study released in 2010 that allegedly showed 36 percent of patients who received the implants suffered knee pain two years after the surgery.

However, in a complaint filed in federal court in South Bend, Indiana, Zimmer claims that the attorneys are only citing one study of just over 100 surgeries that were conducted by Chicago physicians, but that there have actually been approximately three million implanted since NexGen was launched.

According to the news provider, since 2008, Zimmer has set aside $179 million in order to settle claims over the alleged high failure rate of its Durom cup hip implant, which could potentially lead to the loosening of the joints and necessitate a follow-up procedure.
