Attorney: No Fixed Window for Depakote Adverse Reactions

Baton Rouge, LAWhen patients were given their Depakote prescriptions they probably thought they were getting all the pertinent information about the anticonvulsant medication. But that may not be the case, says J. Benton Stewart II, an attorney at Stewart Law P.L.L.C. Compounding the problem is the fact that there is no fixed time frame for Depakote side effects to appear—and some patients may have taken Depakote without ever realizing it.


Depakote was approved as an anticonvulsant medication but was later found to have an effect on brain chemistry, so doctors began prescribing it for off-label uses such as for migraines, bipolar disorder and mania. Patients may have been prescribed Depakote for any of those uses without realizing they took that particular drug.

"Is the injury an acceptable medical risk to the patient? Depakote patients are not being allowed to make an informed decision, and that's a problem"
Furthermore, there is no fixed window in which patients could suffer adverse effects from Depakote.

"If you were to start today, you could take two pills and have a reaction to Depakote," Stewart says. "You could take it now and three or four years from now have pancreatitis or liver failure that is linked back to the Depakote use."

Although that lag time makes lawsuits more difficult, there are lawsuits being filed alleging Depakote caused patients to suffer liver failure and pancreatitis. It has been shown that Depakote caused birth defects among infants who were exposed to the medication prior to birth.

"Most of the press is about birth defects such as neural tube defects and spina bifida," Stewart says. "But we're also seeing deformation of the spinal cord and nerve problems in infants. If there's an issue, it's because the mother was given Depakote during pregnancy. We've just found out during discovery [a phase of a lawsuit] that women who had migraines and were depressed during pregnancy were given Depakote. But what is the cost of putting them on Depakote versus the cost of a migraine? Ultimately that cost was their babies' heath after they were prescribed this dangerous drug."

Children who were exposed to Depakote prior to birth may develop seizure activity or liver failure. Other health problems include a risk of pancreatitis, which Stewart says has been seen in both adults and children exposed to Depakote. Symptoms of pancreatitis include unexplained nausea, vomiting, back pain and difficulty putting on weight.

According to Stewart, one of the issues is whether or not patients were able to make an informed decision about using Depakote.

"Is the injury an acceptable medical risk to the patient?" Stewart says. "Depakote patients are not being allowed to make an informed decision, and that's a problem. If you're fully informed about the side effects and the doctor says, 'You have severe epileptic fits and I still think you should use it because it can save your life,' that's one thing. But you have to have all the information to make a decision. Was there an equally effective treatment that could have controlled the injury and would not have exposed the patient to the potential side effects?"

The statute of limitations on Depakote varies based on the state and is based on when the patient was allegedly injured by the medication. For some patients, that means a lawsuit is not filed until years after he or she was prescribed the Depakote.

"If people have any of the symptoms of an adverse reaction to Depakote, they should go back and determine if they were ever prescribed Depakote and immediately contact an attorney to ensure the statute of limitations doesn't run out," Stewart says.

I was prescribed Depakote 20 years ago by my own father, a psychiatrist who mis-diagnosed my encephalitis as "bipolar disorder", only to end up with pain in my upper abdomen that turned out to be a swollen liver. My father refused to recognize or even acknowledge that I was i pain much less that it was occurring in the area of my liver, and denied that there was even any danger at all associated with that "side effect". On my own accord I stopped taking it and the painful swelling stopped, then started again NOT knowing of the dangers posed only to have the same "side effect" quickly re-emerge, leading me to demand that the treatment be stopped permanently. Had I known of the risk I'd have refused treatment. My father failed to file an adverse event report--such filings occurring in only one in one thousand cases of such incidents per the usual Gilman/Freemasonic/Luciferian protocol that prevails over all of the cults of professionalism (licensing bureaus, police, judges, corporate boards) so it is no wonder that this problem persists to this day. This is the standard m/o of all our civic institutions--both private and public--as the cult of the Gilman and the Campbell have run our nation since the very advent of "The Military Industrial Complex" when The Masters covertly took-over by way of George Washington's reliance on the lineage of Campbell's Alphabet Soup (CIA, FBI, CNN, ABC hence a joke) when he called for the procurement of the arms (metallurgists/Satanists/bankers) back at the time of the revolutionary war, so deeply embedded is this sort of scam. This is why the courts see fit to deem a person devoid of the right to due process merely by way of arbitrarily labeling any defendant as a so called "conspiracy theorist"--i.e. a well informed citizen. The problem therefore highlighted by this case cuts to the root of all that is corruption in our democratic republic, wherein the notion of our being governed by constitutional law as apposed to case law, statutory law, British Maritime Law and Papal Cannon Law, is was and always will be a mere farce. It's all bait-and-switch with the problem of informed-consent surrounding the Depakote issue being merely a singe twig on a branch of a tree that is FROM HELL--a movie about my own family as Jack the Ripper. "Gillette, the best man can get", hence "only the good die young". same as it always was. Freemasonry is the cancer, death by Depakote and so much else the symptom. You now have been both warned and informed. King Camp(bell) Gillett and his initiated ilk rule the roost.

I have suffered from severe migraine my entire life. Years ago my "neurologist" prescribed Depakote. I ASKED ABOUT ALL POTENTIAL SIDE EFFECTS. I was told "you may experience some tiredness but it should go away". Not only did I have severe fatigue, I also experienced alopecia, Extreme weight gain, severe sweating, trouble exercising, personality changes, aggression, swelling of face abd all extremities etc. I asked my "neurologist" about these issues; I was advised that the symtoms were probably from something else. I weened myself off this horrible drug " DEPAKOTE". Most symptoms subsided immediately but I believe that DEPAKOTE caused me permanant damage. It makes me furious that "doctors" DO NOT TELL YOU WHAT COULD HAPPEN WITH MEDICATIONS. I now research ALL side effects with any medication doctors want to give me. If you value your health I advise others to do tge same because if you die from a medication most doctors dont care and you become a medical statistic gone wrong and your death then become irrevelant and forgotten by " doctors" who take an oath to help and protect you.

I suffered traumatic brain injury. Doctors had me on this medication with me unable to understand the side effect DAMAGES happening to my health! SERIOUS WEIGHT GAIN OF OVER 130 POUNDS!!!!! A MAJOR HEALTH CRISIS IN ITSELF!!!!!!!!!!!!!!!!!!!!!!! ALSO THERE IS LETHARGY WHICH INTERFERES TOO WITH OTHERWISE HEALTHIER DAY TO DAY LIVING!!!!!!!!!!!!!!!!!!!!!! AND OTHER COMPLICATIONS!!!!!!!!!!!!!!! NOTE TOO, MY FAMILY ARGUED THESE CONCERNS TO THE PRACTITIONER WHO TRULY DID NOT CARE WHAT DAMAGES THIS VERY UNHEALTHY MEDICATION WAS DAMAGING!!!!!!!!!!!! Son has been on Depakote ER for several years, currently in the hospital with acutr pancreatitis and still can't determine why. Has had low WBC, low platelets since before admission, since 2013. GI dr is thinking this might be med related. As several other tests have came back negative thus far. Do I have a case?

I was prescribed Depakote..1500mg a day for about 15 years... I have not had Depakote now in over five years. I do NOT consume alcohol.. maybe two drinks in 4 years. I am now in early stages of hepatic failure and the only link to be found is to depakote usage . It is scary that a medication given to control manic episodes has done this years after discontinuing usage. Thank you for taking the time to help Depakote users with this alarming issue.

My son Scott was prescribed depakote for bipolar depression his sophomore year of high school, 2009. Five weeks late he was hospitalized for pancreatitis. Because his pancreatitis was severe his small bowel shut down. He spent 30 days in the hospital and lost 50 pounds. Sense then he has suffered pancreatitis two more times with hospitalization. Prior to depakote and pancreatitis my son never had any digestion problems, now he has chronic diarrhea and has developed cilliac disease. This effects him daily, and he has had a hard time holding a job because of his frequent trips to the bathroom. Does he have a case?

I was prescribed depakote to prevent and control migraines caused by a traumatic brain injury. I have taken an increasing dose of depakote for about a year. October 2015, my liver enzymes were almost 3 times the normal limit. I have stopped taking depakote and my liver enzymes remain 3 times normal. Can you help me please?

I was diagnosed with have seizures and having partial epilepsy, which I was prescribed by my neurologist, Depkote. In 2006, I was pregnant, had a miscarriage in August, that I keep bleeding non-stop up until 2007, and had a Blood transfusion, which I had 2 more since then, I had a 2 seizures, 5 mini strokes, mild stroke, in one day. I've had 2 brain anurysms while taking depakote up until 2012. Then they changed it to the generic brand Divalproex, which in 2013, while still on this medication, I had a mild stroke and was diagnose with liver disease as well. I want to know do I have a case and if I do, could u have a lawyer to contact me, please! Thank u!

i was on depakote for only a short period of time when i was around 11-12 years old and my mom had called the dr regarding my hair falling out they told me it was from the depakote and i was experiencing the start of liver failure please contact me if you think i have a case

I have been just diagnosed with liver failure and my drs. medical opinon is that more than not it was the depakote i was taking for around 10 years.pleas contact me asap as I now have i life threathting issue. Thank-You Michael
