Indianapolis, IN: Since 2003, thousands of IVC Filters lawsuits have been filed nationwide. If you have an IVC Filter claim, however, file sooner than later: Cook Medical claims were dismissed in the current bellwether case because they were filed more than three years after the device was delivered. But thousands more cases are set for trial.

Phoenix, AZ: With the scheduled start of the first Bard IVC filter bellwether trial set for next month, all eyes will be on the outcome to gauge how the remaining bellwether cases might fare, and ultimately what general direction the remaining 3,500 cases in C.R. Bard multidistrict litigation may wind up taking.

Phoenix, AZ: The first Bard IVC Filters bellwether case begins on March 14 in Phoenix before U.S. District Court Judge David Campbell. The three-week jury trial--Sherr-Una Booker v. C. R. Bard Incorporated and Bard Peripheral Vascular Incorporated (2:16-cv-00474)-- involves tilt, migration, fracture and perforation with serious injuries. The Plaintiffs claim that due to manufacturing and design defects, Bard filters are more dangerous than other IVC filters, and that Bard failed to warn about the higher risks.

Washington, DC: When the Cook IVC filter manufactured by Cook Medical and identified as the Cook Gunther Tulip Filter System achieved formal approval by the US Food and Drug Administration (FDA) in 2003, it was approved under an FDA 510(k) Clearance designation – a shortcut to the approvals process that continues to generate a fair bit of controversy. Advocates say the fast-track process allows the introduction of promising medical devices to the marketplace sooner. Critics, however note that medical devices such as the inferior vena cava filter are plugged into the market and used on patients without thorough testing.

Washington, DC: While we wait for the bellwether trials to proceed in the Cook IVC Filter Litigation MDL and the Bard IVC Filters MDL, maybe it’s time to have a conversation about root causes. How did we end up in late 2017 with more than 2,000 pending IVC filter lawsuits? One thing these IVC filter injury cases have in common is this: the medical devices were approved under a fast-track Federal Drug Administration process, known as 510(k) Clearance. Is the process flawed?

Indianapolis, IN: One of the manufacturers of inferior vena cava filters facing lawsuits is Cook Medical, the enterprise behind the Cook Celect line of IVC filters. The devices are placed into the inferior vena cava, the primary artery returning deoxygenated blood from the lower extremities up to the heart and lungs. The devices by Cook and other manufacturers have been known to fracture, or become dislodged and drift towards vital organs. Designed to be removed, they often can’t. One Cook Celect IVC filter lawsuit filed last April alleges negligence and a defective design.

Cook Celect IVC Filter Lawsuit Goes to Trial October 9, 2017. By Anne Wallace.
Indianapolis, IN: On October 23, 2017, Hill v. Cook Medical, Inc., et al, 1:14-cv-6016 will go to trial in the US District Court for the Southern District of Indiana. This will be the first of three IVC filter lawsuits to be heard in the brewing multidistrict litigation (MDL) against Cook Medical, Inc. That MDL now includes approximately 1,900 individual lawsuits. Although the outcome of the Hill bellwether lawsuit will not be binding in the other cases, IVC filter patients and their attorneys are paying close attention. The outcome will affect the settlement value of similar cases.

Denver, CO: We’re just beyond the second anniversary of the release, and publication of a study in August, 2015 that placed a particular focus on IVC filters manufactured by Cook Medical, and their Cook Celect IVC filter line. It should be noted that inferior vena cava filters made by other manufacturers have been similarly problematic and have suffered failures not unlike those of Cook Celect filters.

Washington, DC: The idea behind the IVC filter may have been meritorious: for those patients at high risk for blood clot or pulmonary embolism, for whom blood thinners are either not appropriate or ineffective, a so-called ‘catcher’s mitt’ strategically placed within the inferior vena cava artery will entrap a blood clot migrating up from the lower extremities, preventing the clot from reaching the heart or lungs.
