Toyota Faces Oil Consumption Defect Class Action Lawsuit

- by

New York, NY: A consumer fraud class action lawsuit has been filed against Toyota Motor Corp. alleging it concealed information regarding oil consumption in the engines of some of its most popular models. The lawsuit claims that the engines were prone to rapidly burning through oil just as they approached warranty expiration, causing owners thousands of dollars in repair costs.

Filed in California federal court, the complaint alleges the defect can cause safety risk that can lead to catastrophic engine failure. The lawsuit claims the models affected include the Toyota Camry, Corolla, Matrix and RAV4.

According to the complaint, Toyota was aware of the defect, and it notified authorized dealers of the problem in 2011, however, Toyota refused to pay to fix the vehicles when contacted by the plaintiffs.

"Plaintiffs ... bring this claim since the oil consumption defect typically manifests shortly outside of the warranty period for the class vehicles-- and given defendants' knowledge of this concealed, safety-related design defect --Toyota' attempt to limit the warranty with respect to the oil consumption defect is unconscionable here,"the complaint states. The lawsuit states that the plaintiffs' vehicles exhausted their oil supply in 3,440 to 4,300 miles ??" well before an oil change would typically be performed at 5,000 miles under Toyota's recommended maintenance schedule. And, according to the lawsuit, once the plaintiffs contacted Toyota, it refused to repair the vehicles under the warranty, claiming it had either expired or failed to cover the defect.

Toyota was made aware of the problem after receiving information from dealers and records from the National Highway Traffic Safety Administration. The company also knew the nature and extent of the problem from its internal record keeping and durability testing, and from warranty and post-warranty claims, the complaint alleges.

The claims, which seeks unspecified damages, were brought under various state consumer protection and business law statutes, on behalf of consumers in California, Florida, Washington, New York and New Jersey. Additionally, the lawsuit claims violations of express warranty, fraud, and breach of the duty of good faith and fair dealing.

The vehicles cited in the complaint are the 2007 to 2011 Toyota Camry HV, 2007 to 2009 Toyota Camry, 2009 Toyota Corolla, 2009 Toyota Matrix, 2006 to 2008 Toyota RAV4, 2007 to 2008 Toyota Solara, 2007 to 2009 Scion tC, and 2008 to 2009 Scion xB. The defect is found on 2AZ-FE engines.

The plaintiffs are represented by Richard D. McCune, Jr. of McCuneWright LLP.

I purchased a 2007 Camry a couple of weeks back (manufactured in Mar 2006) and it is already apparent to me that it is burning excessive oil, probably at a rate of 2 qts per 2000 miles. This was a single-owner vehicle, and she had all service done at the dealer, and I have the complete record. No where did they tell this owner that her needing oil topped off so often was unusual, so they didn't do the fix even though it is apparent that this vehicle should have been one of the one's fixed.

So please do add me to the class action lawsuit.

2013 Toyota Prius with 106,000 miles. Had the car since new with NO problems until I checked the oil and it was low. Added 2 quarts and had the regular oil change service at Toyota . After a few trips I checked the oil and it was down 1/2 a quart , topped it off and drove 200 miles on a trip and its down 1/2 quart again. UNACCEPTABLE Have had Toyotas since 1977 and will not EVER buy another

I have a Prius V 2013 and as I hit 125,000 miles I started to have an oil consumption problem. The first time I thought maybe they had forgotten to fill the oil after the change and with less than 1200 miles my light went on and I added 3 quarts of oil. I have called Toyota corporate in Plano, Texas and they stated that they had never heard of this problem ..a bold lie! Then I spoke with a customer relations person in New Mexico and she stated that she had never heard of the problem and neither had Toyota and they had sold over 1,080,000 Priuses since 2000. Another lie as the internet and their maintenance department had. The service person at the dealership said that it was a defect in the Prius engine something to do with the rings and they could perform a oil consumption test on the car for $125. I already knew that it was burning oil and did not have a leak but I wanted it documented. They did an oil change and told me to return in 1100 miles so they could see how much was consumed but to carry extra oil in the care with me. The other resolution is to have the engine rebuilt which isn't covered by the extended warranty. I had a 2005 Prius for over 250,000 miles and no problems so what gives??? My sister has a Prius V in Michigan and she is having the same problem. Is another lawsuit in order? Won't buy a Toyota again and have had them since 1990.

We need another class action against Toyota regarding the Toyota Prius. We are having the identical issue as everyone else. Seems like a perfect opportunity for a qualified class-action law firm. Our 2010 Toyota Prius started burning over a quart of oil every 1000 miles, REQUIRING OVER 10 QUARTS OF OIL TO BE ADDED BETWEEN OIL CHANGES! It's an obvious defect, worthy of a class action, or government action due to the environmental impact.

I have a 2009 Rav4 and it looses 2 quarts or more of oil between oil changes, this is ridiculous.

I had 2010 Camry LE and had Engine oil burning issue. I bought Brand new 2014 Camry LE and after driving of 100000Km I noticed same Engine oil Burning issue. Warranty is expired and dealer said keep monitoring. Very Disappointment with Toyota. No more Toyota Cars.

2010 Prius, same oil consumption problem, I now have 180k on car but religiously watch oil level. Holding at about a quart every 800 to 1000 miles. Nice problem change the oil and filter every 5k and add a quart every 1000??? Toyota should be ashamed. I also have a 2001 Prius that doesn't use or move from the high & low mark on the dipstick between changes with 150k miles.

We have a 2013 Pryuis V with 124,000 miles on it. We take great care of this car and all of a sudden it is burning oil like crazy. My wife has a 50 minute drive to work and I have put 3 quarts of oil in the last three weeks. Not Happy.

I've had this problem with my 2010 Prius since it was at 100,000 miles and my service manager indicated that Toyota knows about this and eventually my car would have a recall to fix my the piston rings. Well, I'm over 140,000 miles and no recall and I have to make sure I'm feeding my car oil like its a vampire. I've written to the FTC, sent other complaints from other Prius owners to the FTC from other sites and have also sent the class action from the other models that received the recall from the defective piston rings that Toyota purchased. My colleague had a 2011 Prius that also had these defective piston rings and unfortunately her engine was ruined and she lost her car because there is not light warning that alerts you that you need oil. Toyota can't afford to have their "#1 selling hybrid" under scrutiny, so instead they prefer just to screw all the Prius owners instead of doing the right thing. This is the 4th Toyota I've owned and I will NEVER buy a Toyota again, nor will I recommend buying a Toyota to anyone. You just don't treat people like that. I don't know about everyone else, but I just don't have money to throw away when I buy a car. I'm not rich. $30K is a lot of money to me. Shame on Toyota!!

Have a 2010 Prius with 115, 000 miles. I have taken care of this car like it was my baby. Never missed a scheduled maintenance. I was a true believer, happy with the quality and dependability of the product and the integrity of the people backing it. Today is February 2nd 2018. Two days ago the engine oil light went on. Took car promptly to Toyota dealership. Got a call the next day. "Your car's engine has no oil in it and you needs massive engine repairs which will cost $4, 500."
So for context, during the prior three months to the day, the engine light went on for the first time and I promptly went to the dealership. They told me that there was nothing wrong with the car but while I was there I should have the oil changed due to that maintenance being required in near future. So with that done, off I drove off a happy idiot.
But Toyota knew about this engine oil problem at least as far back as 2014. At that time or thereabouts a (TSB) Technical Service Bulletin was issed to all dealers describing the engine oil issue. So they knew about the problem but kept it on the QT. Thanks Toyota.
There's so much more to say (all bad, misleading and disappointing) about the stonewalling I received but I have to move on and write it off to life as it is in the U.S. today it goes without daying that no one I have spoken to about this has given a damn especially the fine people at the Toyota "Customer Experience Center.
By the way when I told them that I had read about this problem on the internet they responded by telling me you can't believe everyhing you read on the internet. I should have said thanks for being condescending but I let it go to millenniel social ineptitude.
So I'm not saying you should buy or not buy Toyota cars, but maybe you I used to be a true believer in their product. In a way it's sad to think I will never buy another Toyota but caveat emptor to all I guess. What a world.

Hello everyone,

I have experienced the same problem with Toyota Camry that I purchased brand new in 2007.

I have been taking my car regularly to the same dealership where I purchased my car for oil changes and services. My engine started smoking/overheating last year and would not cut on.

I was told that it was a separate problem. Not one time was I informed about the defect.

I am extremely disappointed. I have spent a lot of money at that particular dealership getting it serviced for oil changes and other services.

I have 2011Camry I purchased in Cleveland. I took it in Sept.2017 for routine maintains. I also asked them to check the oil because it was low. So The oil consumption problem is happening in the regular 2011 Camry not just the Hybrid. I am waiting to see if they are going to fix issue. They did an oil consumption test and it is using more oil than normal.

I am had excessive oil burning and had to replace the engine on my 2007 Camry. It's strange but I had the same exact identical problem with a 1998 Camery. I was told that the vehicle needed oil, long before 5000 miles; it was out of oil before 3000 miles. So, Toyota needs to go back as far as 1998 with the 4 cylinder Camry.

Posted by

on
Toyota may need to go down to 1998. My 98 Corolla is burning engine oil like crazy. Many owners were complaining about it on the web. Toyota denied it was a defect. The good thing for Toyota is old 98 Corolla might have been trashed away by the owners and less people spoke against Toyota any more.
With the pride of being world's top car manufacturer, get these sick patients and treat them. You don't want to see all the sick Toyota around as "good" promotion for your brand!

I have had a 2007 Toyota Rav. I had no problems with the vehicle up to 127000 miles. Without warning the engine exploded putting a relative in a perilous situation. Upon examination by my mechanic, he stated there was absolutely no oil in the car. This happened 2700 miles after an oil change. No lights ever came on to warn of the situation. I am seeking to join a class action lawsuit.

I have a 2012 Prius with 135K miles. My warning light came on, I read the owner's manual to see what the warning light meant. Maybe better check the oil, 2 qts low. I drive 175 miles round trip to work, no idea this was a problem with Toyota. Never had a vehicle to use oil like this! No more Toyotas for me, I bought this one for the long haul and the great gas mileage, not bad oil consumption. This is ridiculous!

My 2011 Prius with 95k miles is burning about 1qt of oil every 1500 miles. The dealer and mechanic have told me "this is normal for older toyotas". This is ridiculous! I am very disappointed with Toyota. I bought this car new with hopes of driving it forever. My next car will not be a Toyota. :(

I had the same problem with my 2010 Toyota Prius. I took my car to the dealer to have it checked out because of the noise when the car was under 100,000 miles, as I had the extended warranty. They said that the car only needed an oil change and was running low on oil. I then took my car back to them to make sure my car was safe for my son to drive 300 miles away to school. They told me everything was fine, and just about 300 miles later the engine seized. I was told by the dealer that if it was something they done or failed to have done they would take care of it. However, once they found out the engine seized for oil starvation they backed out and stated it wasn't their issue. They offered me 1000 dollars, but I didn't take it because my engine is going to cost about 6-8k.

Owner of a Scion Xb 2008

Like many, my scion xb burns oil. I took it to Toyota of Hollywood to conduct the oil consumption test and my car failed to reject (level oils are OKAY). This is a blatant lie because I check the oil levels weekly and have to insert a quart of oil ONCE every other week. Hollywood Toyota was completely dishonest and I would like to see them held liable. What can I do in regards to my vehicle? oil consumption is excessive like thousand of other Scion owners. Please update with information.

Had the engine repairs done by the St. Charles, IL dealer and my car came out with other issues that they will not address. The pick up is better but now the car has a significant vibration in the whole body of the car and loud engine noise when idling. Took it back to them and they checked to make sure everything was secure and determined the vibration was "normal" so they documented it as no issues found. I told them this was not acceptable as the car did not run like this prior to their repairs and I was told I could get a second opinion (which would be at my own expense, obviously). Called the customer assistance # from the original notification of the oil issue and they told me the same thing, since the dealer stated it was fine they couldn't do anything to help me. It's basically my issue now and if I could prove that it has something to do with the engine repair I could bring it back to Toyota and they would review it. Will never buy another Toyota.

We have an 07 Camry and it too would go thru a lot of oil. I never saw a leak anywhere and never saw it smoke. Couldn't figure it out. It gradually used more and one day while driving the engine lite came on for the first time and about 30 seconds later, started screeching and banging and losing power . I couldn't pull over quick enough and that was it, the engine was ruined. Now remember, I changed the oil every 3k miles. As soon as the maintenance lite would come on, my wife would let me know and it was changed by me in a few days. We took excellent care of this car so to get a lot more than 202k miles out of it. The rest of the car is probably an 8 on a 1-10 scale. I think Toyota should at least pay for a used engine swap. (About 1500-2000 bucks) How do I make this happen?

Re Toyota 07 Camrey LE we bought this car new from Burdick Toyota Syr Ny by 30,000 miles car was using 3/4 - 1 qt of oil between 2000 mile oil changes, Service writers told me 1 qt between oil changes is considered Normal but they did not document my complaint. By 36,000 it was a little worse they told us same story Toyota considers normal and we were now at warranty deadline besides,Now with 225,000 miles still adding oil we get a recall letter so this past June took car in for Anaylis check they changed oil & sealed Mtr they informed me it would now need to burn approx 1-1/2 qt s in 1000 miles So after reading all the high prices and extra charges not covered by Warry, I have one thing to say to Toyota "keep your new pistons & Rings " Whom ever agreed to this class action did us the customer no service at all. This form of repair is not rebuilding an engine just another way a dealer can make more money on a car that you would not Warry when new.Big deal Toyota I will never forget. Perhaps you will not care as well on past 2- vechile s purchased new WAS NOT TOYOTA'S.

2007 Camry
I just dropped my car off for the oil consumption engine repair. Within hours I also received a call from them stating my valve seals were old and could cause leaking oil. Normally the job would cost $1800 but since they had the engine apart it would only cost $572. Is it just a coincidence that they are finding a separate issue that would lead to an oil leak when that is the issue they are supposed to be fixing? It appears that others are receiving this same recommendation after their engine is torn apart. Do I really have a valve seal issue? Or, could the valve seals be defective and part of the oil consumption issue that they have not owned up to? I would be curious to know, out of all the repairs they have performed so far, how many customers were given this same recommendation to have the valve seals replaced.

After Engine Cover repair noted by Toyota dealership insignificant oil loss, and a water pump and timing belt replaced at 132,000 miles.
2008 Prius 3 weeks later engine complete failure. Lost 3 quarts of oil no explanation. Dealer checked it and said engine would have to be pulled and repaired. I bought my 2007 RAV4 believing it would be the last vehicle I would ever own...my 1987 Corolla lasted five months shy of 20 years...and I was able to sell it for 22% of its original cost even with its 325K miles.... AMAZING!

The RAV4 has 172K miles and in the last year started using oil between it's 3K oil changes. Three times using more than two quarts...essentially out of oil...unmeasurable. The dealership, on the phone, laughing referred me to their new car sales department, saying the car is unrepairable and I should look at buying a new car. I am 73 years old and did not expect to buy another car. This is a HUGE unintended expense for me, a huge financial loss. I won't be buying a car from THAT dealership. Their push and lack of consideration prompted me to another one.

I have the 2010 Toyota Prius with 62,000 miles. The last oil consumption test revealed that it had guzzled over 2qts of oil in less than 1,200 miles. So, now my car is at the dealership with the hood up and they are tearing down the engine per Platinum Care's instruction to determine if the problem is covered under the Platinum Service Agreement. I am without a car for 2 days now and according to the dealership, I could be without a car for 3 weeks. This is ridiculous and a complete waste of time. Why won't Toyota take ownership of this problem? I want a resolution Toyota. Give me one!

Well it no secret that Toyota new about this problem,
it was designed to fail by their engineers. As i am guessing what discussions took place in the Board
room at Toyota,i would have love to have been a fly on the wall in that meeting. As a prior mechanic for 13
years, you learn what is designed to fail, and in this case it was a designed flaw, and as in most appalling
fashion Toyota is denying that this is a problem. The engineers probably told their top notch executives
that this would occur, and as you know being a owner of these vehicles it a great money maker,PROFITS
FIRST AND PEOPLE LAST. On one more note there are hundreds of thousands of cars and trucks that are
designed to specifications that don't require owner to
have a oil drum mounted to the roof of their car. This is corporate greed at is best.

I am the original owner of a 2006 Solara that currently has about 56,000 miles. Last year, the check engine light started turning on, but it wasnt until this year that I found out the problem. My car is burning excessive oil, about 1.75 quarts every 1,200 miles. Toyota issued a TSB in 2011 and is only willing to fix the 2007 and 2008 Solaras. However, the 2006 model has the exact same engine as the 2007 and 2008's. I already called corporate twice and they refuse to pay for the repair, arguing that it is out of warranty. I am aware of that, but it is obviously a manufacturng problem and the problems usually start after the warranty has expired. My car is low on mileage, it has never been crashed, and I've done all the maintnance at the dealership in a timely manner since the day I bought it. I'm extremely upset at Toyota. If they dont pay for the repair I will never buy a Toyota again and I will try to discourage everyone I know from buying a Toyota. I have been researching this issue and there seem to be thousands of people with the same problem. How can Toyota be getting away with all this? I don't know if it's too late, but if not I would love to join a class action lawsuit.

Since 2015 I was informed by the Elgin Toyota dealership during the oil change that my Toyota 2007 RAV4 had virtually no oil. The dealership replenished it and 1000 miles later the oil light comes on and no oil was registered on the dipstick. Sept 2015 I was finally told about an oil consumption test which they said I passed yet oil would disappear now within 800 miles. They agreed to do another oil consumption test and during that time the oil light came on so I drove to the nearest dealership which was in St. Charles, IL. They told me there was no oil in the car and the Elgin dealership should had never passed my car. I had to do a 3rd oil consumption test because I was a few miles over the required mileage for the 2nd test to be valid. In February 2016 I failed the oil consumption test and they put me on the wait list and told me they're out of parts to fix the car. Despite repeated phone calls to service manager Sean and open case at the recommended toll free # I have not been taking care of. The car can not drive even 400 miles without me refilling the oil. They basically told me there is nothing they can do and the district manager did not approve a rental car. I am a professional businesswoman and have to go under my vehicle every 2 days! I have to purchased a 5 quart jug of oil every two weeks and was told to keep my receipts because they will reimburse me, which at this point I don't believe them because they don't appeared to have any attention on fixing the problem. I'm worried my only means of transportation will blow its engine which is what Toyota probably wants to happen so they can blame me and that's one less person they have to deal with. I paid over 20K for this car.

I have a 2009 Toyota Corrolla that is on the oil consumption list. After a month of operating I checked the oil and noticed that is was on the add oil mark. So, I added sufficient oil according to the operators manual. I checked the oil again three weeks later, and this occurred again, and every month to this date. I have changed the oil in my vehicles every three months as a routine procedure. When I noticed the oil consumption the second and third time I took the car to the Toyota service center, and was told this oil consumption was normal. (This is unreal, I have never owned a vehicle that consumed one quart of oil following the month of the oil change. How many new car owners buy a quart of oil to carry on the vehicle to add to the engine consumption???) Well, the engine started knocking and was taken back to a Toyota service center for the oil consumption repair/replacement. And as of this date, Toyota is now refusing to repair or fix the engine, because the oil consumption test cannot be done, due to a noise in the engine. Well I want to the added to the class action law suit, for all the same reasons cited in the class action law suit. According to the Toyota service center contact, the Toyota regional manager has the authorization to approve the vehicle repair/replacement but has refused to approve the repair/replacement. Now, does the class action law suit, provide a provision where Toyota Regional Managers fail to comply with actions? And what is our recourse when this occurs?

Posted by

on
I would like to join in with the class action lawsuit. Toyota keeps telling me I passed the test, but I know it's not normal when I have to pour in oil in between oil changes. I feel like they overflow the oil just so that they can pass it and not have to worry about it. The thing is sealed, so we have no way of knowing. After doing an oil change, I found out they overflowed by 1.5 inch above the "full" mark.

I noticed that the car wasn't accelerating as it should. On the way home, it started to stall and sputter. No engine warning lights came on. I had to drive home in the slow lane (to Mass) with my hazard lights on. I brought it right to an auto shop. The mechanic worked on it for 2 days and could not find what the problem was. Said that the engine was shot and that I should contact Toyota. How can this happen with such low mileage? I expected to get 200k at least.

I traded in a perfectly good car for a 2008 Camry that has been burning oil practically the entire time. The light would come on approximately a year after purchasing the new camry and their me mechanics would lie and say it was a sensor. That was 2 years after purchase. Though toyota has sent letters out about having a test the test itself is rigged. They actually add oil when it's low and then measure. Someone please hold them accountable. What they have done is immoral.

I have a 2008 Toyota Scion XB. I have had problems with the oil since 40,000 miles. I had it to the deal ship that I bought it from 5 times for the same issue and they told me each time nothing was wrong. They made me think I was crazy. I have to kept adding oil all the time and my car is so messed up because I never know when to change my oil. I finally got a notice in Febuary of 2015 in which it said about having an oil consumption test done to it. I called Toyota and told them the story I am telling you and was told.. Well enough of people complained so now we have to act upon it. I was so made. I have taken my vehicle in and I failed the test. The parts came in and they did my car and guess what. The parts FAILED. My car is now back at the shop. Help me if you can????? Thanks

My Camry 2007 failed the Oil Consumption Test back in July and was waiting for the fix. The fix as per Toyota is to replace the Pistons and the pistons rings and to be done free of charge.

Today got a call from Toyota and asking for other repairs that need to be done to the tune of $2000. Enclosing the list below. Now that the engine has been taken apart I feel that i'm oblige to do the repairs. A warranty job repair costing me $2000, at this time of the year. Bye bye Christmas for the kids.

I have a 2007 Camry which I purchased in California. I have had to respond to a recall on acceleration problems while driving the car. I took it in to the dealer to be reprogrammed. My car has been using a lot of oil. My car, as of 2014 after moving to Florida has a dashboard that is becoming a sticky goo and I have been waiting for the dealer to call me in to have this replaced. Apparently they cannot get the part. I have recently been informed of a problem with the auto window control. I have been so disappointed in this vehicle. I cannot trade it in because of the dashboard and I will never again own a Toyota. This car is in excellent condition and only has less than 44,000 original mile.

I have a 2010 Prius with over 125k miles and I noticed the same problem with excessive oil consumption after 100k miles. I checked the Internet and there are several similar complaints from customers with same MY Prius. I'm burning through about a quart of oil every 1,000 miles which is ridiculous.
