State Farm Totaled Vehicle Undercompensation

State Farm allegedly determined the value of totaled vehicles without using the asking price or actual sales price of vehicles with the same make and model. Department of Insurance regulations require the use of either the asking price or actual sales prices of comparable cars in the same local market and that adjustments to the values of comparable cars be adequately explained and supported. The use of any other values or the failure to justify adjustments violates the regulations.

What happens if payment has been issued for total loss stolen vehicle and then the vehicle is found? Can they retract the payment issued?

I was hit from the rear when a speeding driver rammed a cadilac into my van while I was was stopped at a light. The impact of the two cars bent my exhaust pipe in half and damaged the rear hatch and back bumper of the car. My air conditioning quit working instantly and my radiator developed a slow leak. (I had just replaced my a/c less than 6 months before.) State Farm did the body and ehaust system repairs, but even after I took the car back a second time it still shimmied all over the road and yanked to the right. I took the car to my regualr repair shop. They did 600 dollars woth of necessary repairs-mostly on the radiator. State Farm refused to reimburse me so I was unable to have the a/c or other non urgent repairs made. Shortly after this my power windows quit working and my blinker got stuck on right flash. The housing under my steering wheel is coming apart at the seams and my car shakes violently when I drive it. I believe my car should have been totalled and that State Farm paid out all they could in repairs leaving me stuck with an unsafe vehicle. I have two young granddaughters who live with me. It was in fine condition and regularly serviced prior to the accident. I am still receiving treatment for accident caused radioculopathy and have been unable to work. I have no money to repair or replace this car.
