Preliminary $11M Settlement Reached in AlliedBarton Employment Class Action Lawsuit


This is a settlement for the Employment lawsuit.

Santa Clara, CA: A preliminary $11 million settlement has been reached between AlliedBarton and a class of workers who filed an employment lawsuit against the security services company alleging it failed to provide meal and rest breaks, to pay adequate wages and did provide inaccurate wage statements, in violation of California labor law.

According to the terms of the settlement, each of the three named plaintiffs would receive $30,000 in service payments. The approximately 43,893 non-exempt hourly employees who worked for AlliedBarton in California from April 2004 through January 2015 would share the net settlement amount on a prorated basis, based on the number of weeks they worked, according to the proposed deal.

The lawsuit was filed by lead plaintiff Gregory Dynabursky in 2012 on behalf of thousands of security officers, alleging that AlliedBarton violated California labor and business laws by requiring guards to perform work duties during meal breaks. He also asserts that the workers had to sign a related on-duty meal period agreement.

The case is Gregory Dynabursky et al. v. AlliedBarton Security Services LP et al., case number 8:12-cv-02210, in the U.S. District Court for the Central District of California.

This company like all security companies should be watched very closely because In My Opinion will skirt the Federal and State labor laws if not kept an Eye on.

I just received a check within the last 2 weeks totaling $706.31 minus taxes along with other friends of mines still employed at Allied/Universal ranging from $45 to $1,000 depending on yrs of service.

Today 11/27/16 and I just receives my settlement check around this week ND it was very low. Is there an error? I worked the whole 2013 year.

So I spoke to one guy name Luis beware of him he's reading off a screen and could careless about the lawsuit and your money. Called back just to speak with someone else and low and behold he kept answering the "800" number so I waited and called back a woman told me the checks were suppose to be mailed the end of Oct but for some reason they were not she didn't know why they just weren't. So no they're not in the mail we will be lucky to see it by next summer just saying. I've dealt with lawsuits before class action and never experienced this before

I have not received a check either, I wonder if they intend to pay anyone. However, I just got off the phone with the administrator and the checks will be mailed on Monday Nov. 21, 2016. So get ready people.

I just spoke with a lady from the hot line number and as of november 7 checks have not been mailed. The woman said that for some reason the money has not been mailed to anyone for reasons unknown. Lady couldnt gevem give a date on when they would be mailed. So for those people who are falling for the okedoke oh its in the mail. Dream on its not

I despise when the justice system screws over the little guy (us workers) while all these lawyers take our (disproportionate) settlements and go golfing. Today's 11/1/16 and out of the 150 plus officers at my job site, not ONE got a settlement check. The 60 day threshold ended 10/12/16, a full three months (60 days) passed, and any inquiry by phone to these people is met with the old fashioned "The check is in the mail." To call about your settlement, the number is 800-378-2591
Looking over all this and doing the calculations, the settlement is a pittance compared to the years of lost meal breaks. Part of the settlement protects AUS from further lawsuits as part of the deal. I'll be making some phone calls and emails tomorrow to see if outside lawyers find this case interesting, along with possible state authorities (OSHA/Labor Board)

I spoke with a rep about a month ago and unfortunately I too misunderstood the check release date. Abs had until Aug to appeal the case if they did not then you would have a check issued 60 days after Aug 16 hope this helps. So the rep said he couldn't give a specific date but it's 60 days after Aug 16,16.

I started working for Allied Barton in 2007 as well and received a letter last yr informing me that I would be getting a check for no less than $850.00 with the checks being mailed out by August.Takisha Johnson you should be getting at least $500.00 w 5 yrs at Allied but if you haven't received anything your name wasn't included
