Mazda Faces Class Action Over Alleged Defective Clutch

Santa Clara, CA: Mazda is facing a defective automotive class action lawsuit alleging certain of its vehicles have defective clutches. The defect represents a significant safety risk to both drivers and passengers, the plaintiffs assert.

Filed by Megan Humphrey, Iris Gonzalez, Charles Bunch, Anne Stom, David Woodward, Greg Thomason, Lisa Massey and Dan Carney, individually and for all others similarly situated, against Mazda Motor Corporation and Mazda Motor of America Inc., the complaint alleges model year 2010-15 Mazda 3 vehicles with 5- or 6-speed manual transmissions contain defective clutch release levers, bearings and pins.

The plaintiffs state in their complaint that the defect causes premature wear to the vehicle's manual transmission and related components, ultimately resulting in premature clutch system or transmission failure.

The lawsuit cites breach of express and implied warranties and violations of consumer protection statutes in California, Texas, Florida, Maryland, Washington, Pennsylvania and Connecticut.

The plaintiffs and others in the class seek a jury trial, damages, interests, injunctive and declaratory relief, attorney fees and costs.

Plaintiffs are represented by attorneys Richard D. McCune, David C. Wright, Joseph G. Sauder, and Matthew D. Schelkopf of McCune Wright in Redlands, California and Berwyn, Pennsylvania, and Bryan Clobes, Kelly L. Tucker and Daniel Herrera of Cafferty Clobes Meriweather & Sprengel in Philadelphia and Chicago. The case is US District Court for the Northern District of California Case number 4:16-CV-02087-KAW

My boyfriend is a Marine and bought a Mazda 3. When he came home his clutch gave out and it's $1,500 to fix plus a towing fee and a lot fee. As a Marine he does not get paid well enough to afford to fix it. He is without a car and cannot get to or from work. He cannot visit me or his family because he has no car.

I reside in Australia-Perth.
My wife bought a Mercedes-Benz B 180 (2014) a demo model (just had under 10th kms) car from a Mercedes-Benz authorised dealer Jan 2016. Just last week I brought it to them with some engine/transmission problem. Now they say to us that car has to be repaired & they won't give to us back until is repaired in 6-8 weeks, because major part comes from Germany. They said that is dangerous to drive car any further because it can totally malfunction during the drive & expose driver & occupants to risk of life. We don't understand how that come the car was sold & given to us in a first place totally unsafe putting our family & others on the risk. They said to us our insurance doesn't need to know about it and they will fix it because it's still sold under a new car warranty.
I have also started to work for Uber 3 weeks ago & I'm losing my personal income. They did provided us with a car loan but I can't use it because of insurance issues which doesn't suit to Uber company.
My wife has sent them very serious email requesting some answers.

What would be your suggestions!
