General Mills Facing Gluten Free Cheerios Consumer Fraud Class Action Lawsuit

- by

Santa Clara, CA: General Mills is facing a consumer fraud class action lawsuit alleging the company' claims that Cheerios is gluten-free are false and misleading. Filed by Jacklyn Haddix, the suit claims that in September General Mills began an advertising campaign to promote its gluten-free Cheerios which included the gluten free designation placed prominently on the Cheerios boxes.

However, according to the lawsuit, the Food and Drug Administration (FDA) began receiving consumer reports of adverse reactions from people who had eaten gluten free-labeled Cheerios. The FDA then tested 36 samples of the "gluten-free"Cheerios and determined that certain samples did in fact contain gluten levels well in excess of the mandated FDA limit for products carrying the gluten-free label.

The class is seeking compensatory, exemplary, punitive, and statutory damages, plus return of purchase prices, interests, reimbursement, disgorgement, and attorney fees and costs, together to exceed $5 million. They are represented by attorney Tina Wolfson of Ahdoot & Wolfson in West Hollywood, California, and by attorneys Jasper D. Ward IV and Alex C. Davis of Jones Ward in Louisville, Kentucky. The suit is Eastern District of California Case number 2:15-CV-02625-MCE-AC.

I’ve ate Cheerios for about 2 years. I started having issues with my intestines getting inflamed and idk what was going on. Come to find out I have celiac and everytime I ate this cereal it’s killed my stomach thinking it was safe. I’ve got infection in my intestines so many times over this and came close dying a couple times from the bacterial infections setting up in my stomach. The box said it was gluten free so this is the very reason why I was hurting and so misread for so long. Now I quiet eating it my intestines has quit swelling up and I can actually use the bathroom. It felt like at times I was blocked off and had snakes moving in my stomach from my intestines being swollen together and spasms it was horrible. This isn’t a joke ppl this stuff needs to be labeled right for ppl like me that does have an allergy to gluten products it’s a real thing. It can kill ppl that has the allergy as bad as me. Idk they was even a lawsuit going on till I read this article. If anyone can reach out to me I’m in Ky that has any info how or what to do about the lawsuits email me or message. I have plenty of dr reports and tons of tests that’s been done over last couple years. This is ridiculous they are doing this to innocent ppl

On doctor's advice, I am avoiding gluten and have been eating Honey Nut Cheerios every day for breakfast. If they say "gluten free" and it isn't, they are responsible! Why would they do that?
