- by

Santa Clara, CA: Cash Fund LLC is facing a proposed class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by contacting the plaintiff without her consent.

Filed by California plaintiff Tenley Hardin, the complaint states that the online business loan company contacted her via her cell phone in an effort to secure business from the plaintiff.

Filed in the U.S. District Court for the Central District of California, the complaint states that Cash Fund LLC allegedly used an automatic dialing system to contact Hardin without her prior express consent. Hardin notes that in 2008 she added her cellphone number to the National Do-Not-Call Registry.

Hardin seeks to represent a class of similarly situated plaintiffs. She is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman P.C. in Woodland Hills, California.

The case is U.S. District Court for the Central District of California case number 2:17-cv-04846-PA-FFM.
