Santa Clara, CA: Wal-Mart is accused of violating California labor law by failing to pay its truck drivers for the time they spend with their trucks during inspections and government-mandated 10-hour layovers.
According to the specific allegations, Wal-Mart doesn’t compensate the truckers for pre- and post-trip inspections, washing their trucks, fueling, weighing their load, waiting at vendor and store locations, performing adjustments, complying with Department of Transportation inspections, meeting with driver coordinators, and taking the rest breaks, as required by employment and overtime law.
Additionally, the truckers assert that the big box retailer paid them just $42 for babysitting their freight by staying with their trucks during federally mandated 10-hour layover breaks, instead of the $67 to $90 they would have earned had they been paid minimum wage.
