Blue Cross Blue Shield



A class action lawsuit has been filed against the insurer for allegedly violating the Illinois Consumer Fraud and Deceptive Practices Act in connection with the sale and issuance of health insurance policies. The lawsuit was filed in Madison County Circuit Court and claims Blue Cross Blue Shield continued to collect premiums for ineligible dependents.

Blue Cross Blue Shield insurance states that family coverage is for health care expenses enrolled persons, their spouse and unmarried children under age 19. Unmarried children who are full-time students can be covered up to age 25. The lawsuit claims the insurance company failed to inform customers when coverage ended, yet continued to collect money for ineligible dependents. The class claims that by refusing to return a portion of the previously paid premiums when Blue Cross Blue Shield denied honoring or paying claims submitted on behalf of ineligible covered dependents, the company violated the consumer fraud act.
