Santa Clara, CA: Trader Joe' is facing a federal consumer fraud class action lawsuit alleging the store-brand tuna is underfilled.
Specifically, the lawsuit asserts that its 5 ounce cans are federally mandated to be filled to 3.23 ounces but according to results of a test by the US National Oceanic and Atmospheric Administration, the cans contain an average of only about 2.43 ounces to 2.87 ounces of tuna, depending on the tuna version.
Based on the evidence that the tuna cans are substantially underfilled, the suit alleges the cans are "illegal for sale in the United States." The plaintiff asserts a number of claims including deceptive acts or practices, negligent.

Good Lord! I buy their tuna all the time -- At least 6-8 cans per month, for years! How can they get away with this? And, why risk losing a long time, frequent customer? I want to be reimbursed, and I want them to stop this deception. Sign me up on this suit.

I bought this tuna for my fathers diet and I was wondering why there was not the same amount of tuna than normal when i was preparing his meals. This has caused conflict with my elderly fathers diet. i want to be in this lawsuit .

I've shopped at TJ for years (it's my main store) and canned tuna is a staple. I have a couple of cans on the shelf right now.
