Starbucks Facing Consumer Fraud Class Action Lawsuit

Santa Clara, CA: Starbucks Corp is facing a consumer fraud class action lawsuit alleging it under fills its lattes. According to the complaint, the latte sizes represented on the Starbucks menu, which are 12 fluid ounces for tall, 16 for grande, and 20 ounces for venti, are not the actual amounts that customers receive when they order a latte drink. "In fact, Starbucks lattes are approximately 25% underfilled,"the lawsuit states. This, the plaintiffs contend, Starbucks justifies by emphasizing that the drinks are "hand-prepared"and vary according to customer preferences.

According to the lawsuit, a standardized recipe put in place by Starbucks in 2009, to save on the cost of milk, resulted in "beverages that are plainly underfilled."

Further, the plaintiffs allege, baristas are instructed not to fill cups that are sized to the exact amount outlined on the menu. "For example, the serving cup used for grande beverages holds exactly 16 fluid ounces, when completely full,"the lawsuit states. "However, Starbucks' standardized recipe for its grande latte calls to fill the serving cup up to '1/4 inch below cup rim.' Thus, when used in conjunction with its standardized recipes, Starbucks' serving cups do not permit 12 ounce, 16 ounce, and 20 ounce lattes."

I WAS a Venti vanilla latte ADDICT for years and I'm not kidding when I say I probably spent thousands $$$$ on them. And now I find out that I was getting ripped off!!! No wonder why they "loved" me sooo much. They were getting money for nothing from me. I now am a Dunkin Donuts coffee drinker and when I order an X-large I GET an X-large! I kicked my latte habit about a year ago and haven't been back since.
I sure hope this goes into a class action suit, because you can surely count me in. All they have to do is look up my "gold card" transactions and see how many I bought. This really P****S me off!! I want to be added to this suit.

I have been going to Starbucks for a very long time, this is very upsetting to me that they do this to people that have been going there for a long time, I though this was how they were suppose to make it. please include me on class action lawsuit

I too notice this issue with Star bucks, I use to go to Starbucksall the time, now I go every now and then. I know that they add too much whip cream on top that takes up the liquid amount that should be in the drink.

Yes I have noticed this as well. Even the Fraps are under filled and then they add a lot of whip cream to fill the cup up.

I'm a frequent customer and lover of my coffee drinks. I think this is ridiculous too and I'm glad they make it a little less so there are no hot spills to my skin, and there is room for my whip cream! Really, if your cups looks too empty, get out of your car or up from your seat and go back to the counter and ask them to fill it. And if you're just too proud and feel ripped off to address the situation, then consider the calories they are saving you a favor! I hope the judge throws this out of court....

Starbucks, has done this short fill on all drinks across the board. I buy Starbucks periodically now due to price compared to content. It is grossly unfair of them to short their customers. How do I add myself to This lawsuit.

I have bought iced and hot lattes for YEARS and they are always under filled. even the soy lattes and they charge more for those ones. Please add me to this lawsuit

I've always suspected this...especially when my venti drinks were gone as fast as my grandes and I was left with a half cup of ice. I have proof of the iced lattes I've bought since Starbucks opened in So. cal.and it is a LOT of lattes. Please include me, if possible. Thanks

Starbucks, has done the shorting on fluid content across the board. I had hot chocolate recently and experienced the same thing. I buy Starbucks periodically as my budget allows. It is grossly unfair of them to short their customers. How do I add myself to This lawsuit.

Wow. Should we all be surprised by now? I noticed that my drinks were never in full ... and guess what, I no longer buy their drinks. I made my drinks at home instead. Cheaper and I don't cheat myself.

I didn't know about the law suit but I can say that the location I frequent the most NEVER gives me a full cup not matter which size I order. 4.72 for a grande and well over 5.00 for a Venti. I usually get a granda and it really makes me mad to pay so much and NEVER get a full cup. I still buy from Starbucks but I now have my own expresso machine at home and I enjoy my favorite coffee everyday.

This is not true in California but as well here in Nebraska. The cups here for Vento Brave latte extra hot no foam ends up being literally half empty and out the door is $5.62 ridiculously price for something I love to treat myself once in awhile but now I refuse to pay this price for a ventilation size cup that in the end is actually a Grande size

I occasionally visit Starbucks. Let's say this suit is successful, the plaintiffs will get a free coffe ( if purchased in a tiny window of time ) and the lawyers will make out like fat cats. They are the ONLY ones that will benefit.

I'm at my local Starbucks almost everyday. I'm kind of a boring guy... I get the same mocha latte everytime. It's delicious. I didn't realize until reading this I was getting short changed. I don't appreciate being ripped on on purpose. I could understand if it was just a pouring mistake, but to have the recipe call for an underpour is fraudulent. I'm in

Seriously, this is a ridiculous law suit and should be thrown out. Everything in not exact even when you get lumber from the lumber yard, a 2 x 4 isn't exactly a 2x4 it is a bit smaller. It is how life works. Besides, many many customers asks on a regular basis not to have their cups filled to the brim, some ask to have room to add more cream. It is not an exact science and shouldn't be looked upon as such. There are so many more important things out there to fight about then a few ounces or less. GROW UP PEOPLE

I too have noticed this issue with Starbucks, but until i came online here to check the results of the met life issue from 2009 before tossing my notice of class action card, I didn't know it was so widespread! I have an app i use when i go into starbucks and haven't reloaded it recently because i've felt so ripped off. Where is this issue going?
