Future Income Payments Faces TCPA Class Action Lawsuit

Santa Clara, CA: A Telephone Consumer protection Act (TCPA) class action lawsuit has been filed against Future Income Payments LLC, by a California pensioner.

In the proposed class action lawsuit, Annette Grind alleges Future Income Payments negligently, knowingly or willfully contacted her on her cell phone, which was a breach of privacy, and a violation of the TCPA.

The suit, filed on behalf of all those similarly situated, claims Future Income began calling Grind around July 2015 in an attempt to solicit services, and that Grind told the defendant to stop calling her on at least one occasion. However, the defendant did not stop calling her, in violation of the TCPA.

Grind is seeking relief on behalf of a class of people, and up to $1,500 in damages for each call in alleged violation of the TCPA. The class is recognized as all persons within the country who have received any collection telephone calls from Future Income Payments.

I’m 100% disabled army veteran and I got what I was also told was something totally different and was even told that my payment was much lower than what it ended up being. I got 8250 from FIP and was told that my payment was like 300 something for 5 years. But after the fact and I had received my payment they proceed to tell me that my payment was 1000 a month for 5 years. I told them I would just give them what I got from them back but they said they wouldn’t do that and that I had to pay the 1000 month for 5 years basically. But I received sometime in January a 1099B from FAW Casson & CO LLP for the amount. What do I do cause I haven’t completely filed my taxes yet but plan on soon cause my tax guy is about done with them. So any info ASAP would be great. Thanks

I borrowed $2519 from Future Income payments and have been paying $300 per Month these people are rip offs and Loan sharks. I want to join the bankruptcy or find a solution to my problem. please help with a phone number of the Law firm handling suit. I paid them about $4000 total.

Im a disabled veteran, who was coached into taking out a loan with FIP, lllc. Which was told it was a payday loan I got $2100.00 loan from FIP, when I tried to pay the loan back in full the next month I was told that I couldn’t pay back the $2100 in full that I had to pay $300.00 for 36 months, which came out to be $10800.00 loan for $2100. FIP started taking $300.00 monthly from my checking account and I got behind paying them after several months. I was receiving threatening phone calls from their employees Latashia Mitchell (800)238-9688 ext:0013, after explaining I had a major operation on my throat which left me unable to speak or walk, I was in a rehabilitation center learning to walk & speak all over again. I tried calling FIP but all the numbers are no longer In service and i can’t contact anyone in regards to this. The terms & conditions of the loan is outrageous, and I’ve been lied to said it was a payday loan I can pay back whenever I wanted to in full to find out it’s not true. I never seen a contract until I tried to pay the $2100 back which stated I owe $10800.00. I called them to discuss the loan terms because they actually emailed me two different contracts after I tried to pay off the loan one stated $300.00 for 5 (five) and the other one stated I owe $300.00 for 3 (three) years. If there is a class action suit I want to be apart of it. They have taken the advantage of millions of veterans and the elderly and this is unconstitutionally!

I too like many of the people who have written comments feel that I have been cheated by this company. About two and a half years ago, i received a loan that was a little over $3000. My monthly payment is $500 a month to date I have paid over $12,000 and I still have no idea what the balance is. I also had to paid taxes on the money I received from them because of the income tax form I was sent. Like everyone else I would like to know a course of action that I can take. This company needs to be stopped.

We received a loan from future income payments defaulted on our payment tried to make payment a title later in month they refused payment. Now they have given our personal information to an individual claiming to be the person who gave us the money. We are so confused because we have no idea who these people are. We get harassing calls and threats that they will come to our home. We feel like this was a direct violation of our privacy and puts our lives in danger.

I received a loan fore 2282.00 paying back 550.00 Fore 48 month. I've told them That I wanted To pay the loan off They said call back the person that takes care of the pay off is in a meeting.They will not return my phone calls so I've had my bank stop an automatic debit from coming out of my banking account. They still won't return my phone calls. Please help me out of this mess.

I am also a victim. I am retired and disabled vet. I am single with two children and was down on my luck with no job but plenty of Bill's. I borrowed 2500.00 from them with a payment of 350.00 in Oct 2016 for 4 years.This loan is more than paid off. They should be restricted just like Titled pawns are to active duty. I have 2 more years on this loan, but it is steady killing me and digging me deeper in the hole every month. I will probably be homeless soon. Can I join this lawsuit as well?

I am a retired school teacher in Corpus Christi,Texas. I took out a $2500 loan in June of 2015. Then I was told it would be $300 a month for 59 months. I told the agent I would pay amount much sooner than that and was told no. It would be for entre 59 months until I paid back close to $10,500. Can I be part of the class action law suit? They no longer answer my calls.I can't even afford my medications anymore!

I took out a loan for $10,000.00, and have been paying $642.00 a monthe for the past 56 months totaling so far $35,952.00. Just like K. Workman, I received a 1099B. I told them that I didn't want the loan, that I was told was simply a
bill consolidation loan. When I realized it was a rip off, I changed my mind. The money was deposited into my acct nevertheless. I sent it back 3 hrs later.
I didn't like the wording of the transactions because I was told loan not purchase. I didn't care, as long as I wasn't gonna owe them anything or deal with them anymore. Then I get a 1099B for 2016, in June 2017.
I can't get it resolved. Everyone is being nasty to me and say they don't have a record of me. I sent emails to the person I dealt with and got no email response. Instead, he called me and told me there was nothing that anyone could do about the 1099B. It was automatically done whether you kept the money or not. If I still had my bank statements, the transactions should be enough to show to irs. He said that I should stop calling for him and just deal with it however I could because he would not speak to me again!
I really wish someone would contact me with help.

I myself got hooked up with Future Income Payment, I borrowed $15K, way back in 2013 and still paying which is $642.00 a month, I try to call the office and all I get is a recording and no one gets back to me. I'am trying to get some paperwork stating how much more do I have to go, So far I paided them back $35,952.00, it's killing me monthly, does anyone have the same problem?,

In 2013, i received 17K for s payment of 747 for 60 months. Total payments were nearly 49K which my final payment was Feb 2018. I want to join the lawsuit. I also received a 1099b form. Bev Montgomery

I was approved a pension loan for $2177, in 2016, from Future Income Payments. As soon as I figured it was a not a good thing, I cancelled the offer. I was told it was too late and that a draft was sent to my bank account. I told them to reverse it because I declined the loan. After a day or so, the money was in my account. I called, emailed, spoke to many others. Finally the rep who dealt with me became available. He said they couldn't reverse the money but he would get permission from his boss to allow me to send it back via my debit card. I did so immediately after speaking to him, on the same day it was received. No more business was transacted and I thought it was over. Late in 2016, I received a 1099B. Unbelievable. I quickly contacted the irs to dispute any debt being forgiven or discharged, and offered to prove it with my bank records. I was told to contact the sender of the 1099B, who was in Atlanta GA 30328
I contact these people, who referred me back to Future income payments. After an exhausting ordeal in getting someone, anyone to speak to me regarding the issue, I finally got to speak with the same rep who I dealt with originally. He was rude and said the company had record of me, and if I proof that the 1099B was not mine, then just present it to its. Later he called me back said it was procedure to send info to their finance dept in GA whenever a loan was attempted whether it was approved or not, so just provide your bank records to irs, because it was obvious no loan was completed, and there is always a number of days allowed to cancel and return the money on any loan offer, and that should be enough. He or the company couldn't take back the 1099B. Irs said they had no record of a 1099B being reported on me. I filed my taxes from 2016 and 2017 without issue. Again, I assumed it was over. I am disabled and retired. I was granted $13 a month in food stamps. After receiving them for one month, I received a letter the Dept of Health and Human Services asking for proof of the stocks and bonds statement from Agee Fischer LLC, in the amt of $2177, reported to them from irs. I will try to handle it again with irs tomorrow morning, 5/8/2018 but I get the feeling I will need legal assistance. I don't know where to turn.

I'm in the same situation as everyone else. I recently retired and thought that I was getting a $3000. loan. I am paying back $400 for 48 months. This is so wrong. This company should be stopped and put out of business. Seems as though they are working on the emotions of people feel who are in desperate need. That was my case. Now I am in a worse situation then when I started.

Same thing, I'm a veteran and I was taking 8 Percocet a day and they got me. They loaned me 4000.00 dollars and they want 25,ooo back.
They wanted 550 a month for 4 years. And after the first payment I let them know I could not afford that so later they put me on a hardship to pay 250 a month or they were going to take my disability check. They would not allow me to file bankruptcy either.
When I tried to just pay the money they loaned me they said no.
Very sticky situation and they raped me while on Percocet. I told them they should of never made the loan while I was on pain killer for my back and they told me I signed. This is who was taking my payments at future income .
So count me in on this class action lawsuit from AZ

Like many of those posting, I also made a huge mistake while searching for a loan because I needed financial help.. Somehow I ended up with FIP At one point I started to cancel the applications during the process, however the sweet talking lady convinced me to complete the LOAN. (When dealing with this company they also transfer your call to several different people . Once again after reading the finalized paper work for $3,241.00 loan, the repayment of $450,00 a month for 36 months is 16,200.00. As of May 2018, I have paid a total of $9,000.00 (balance of $7,200.00) I have filed a complaint with my state's consumer fraud agency who has a class action suit againist this FIP, They also sent me a 1099B, for which I had to pay taxes on as income in 2017.. I became curious and started to research FIP, when they didn't deduct the $450 for the month of May 2018. I found all of these complaints and lawsuits from various states including my own state. I want out of the remaining balance and receive fair restitution on the amount that has been paid.

I am a retired veteran and I am facing the same situation. I needed money because I fell on hard times as well back in 2012. I was called and harassed on several occasions and even had someone come to my house with a notice stating that I was being sued by FIP. They have been calling and harassing me to make a payment every month since then. I have been paying 250 dollars every month. But this month when I called to make another payment its like they have just fallen off the face of the Earth. I really would appreciate it if someone would contact me about my case and help me resolve this matter.

I got a $3000 loan in December to help defray the cost of moving. As a retired teacher, I could manage $300 a month for 60 months (the norm) but $300 for 10 years!!?!!?!?

I recently had them try to take out a double payment on the same day that was not right. I requested that the second money be refunded to me the humaled around and it took over a week to get my money Back. They also said they could not put the money back into my Checking account they rook it out of . They can automatically take it but can't deposit back into my account. Very disappointed with the Company. They are robbing people of thier pension I would gladly joun a suit against them.

Future Income Payments said they could give me a Debt Consolidation Loan in the amount of $3300.00. I am a 100%disabled civil servant and a veteran. They knew before hand my pension was 100% disability pension, they knew I was married, they knew my wife had survivor benefits. In the final paperwork that came, after I had signed because their E-Signing program wouldn't allow me to see the paperwork, says it's a Pension Lumpsum Sale for 26400.00 (almost 800% interest), says it was a retirement pension (when they had the paperwork from my state before they had me sign stating my pension WAS A DISABILITY PENSION), their paperwork says "NON-MARRIED" (but my wife is listed as the co-account holder and they knew I was married before hand), their paperwork says there are No Pension Survivor Benefits when in fact my wife does have Pension Survivor Benefits (and the clearly had this information before hand), I have contacted the Missouri State Attorney Generals Office and their attorneys had written back a letter saying their go to answer, "this is not a loan but the sale of an asset". Why on earth would I "sell them $3300.00 for $26400.00"? They said Debt Consolidation Loan on the phone, then I find all this out after the fact. The Missouri State Attorney General Office received a letter back from them stating they would be willing to dismiss the contract from $1100.00. If they are so sure in their legal standing why would they agree to a dismissal of the agreement for $1100.00 (which is exactly what they say I have left owing of the original $3300.00 they "let me borrow", which also is not true because I owe less than that on the original $3300.00)? This is a total scam and all of us here need help to stop these predatory loan sharks from chumming the waters. My continued worsening medical issues being disabled are an issue. Can Bankruptcy wipe out this "loan" with the way they worded it to get around the federal and state lending laws?

PREDATORY LENDING ON SENIORS PENSIONS! have been paying Future Income Payments $300 a months for several months on a $2,500 cash-advance and all the payments has been applied to the value of the loan and nothing towards the $2,500. I called for a pay-off and they quoted $3,000 by February 2, 2018. After that it would take 50% of $17,100 to pay it off.
James, as the collections department, stated there was no principal that we could pay down, when we asked if we could pay extra to pay down the $2,500 that we borrowed. The answer was no, we had to pay down $18,000.00 and all that we have sent has gone towards it, apparently, $900.00. They continued to call us to get into this situation, and we did not fully understand the contract, nor did they explain it! WHAT CAN WE DO GO GET OUT OF THIS MESS!

I also got into a Financial bind and could no longer afford to pay them. If anyone wants to stop the phone calls, send them a Cease and Desist letter. That won't eliminate the debt but they will now have to send mail to you. I just got a letter today explaining I am behind. I don't know if I file a Bankruptcy if that would eliminate the debt, but I can't survive if I am paying them $450 out of my pension and I pay a portion of my retirement for child support and another portion to my ex wife and it leaves me around $200 left out of a 20 year pension. Obviously it is a scam company that takes advantage of military veterans in already a bad situation.

I'm in the same boat as many people on this forum. I fell for their scam. It took the over 3 weeks to deposit my money and I only received $2300. I am also on VA disability which is my only income for my family. I am a widow of 9 yrs. I would like to join the class action suit if possible.
These people won't answer emails or phone calls. They told me there is no APR on this type of loan.

FIP has been withdrawing $350 from my bank account each month, yet I can’t find a copy of any contract I signed with them. They contacted me by my cell phone at first. The representative talked me into accepting a package of food products which I could “sell to offset any payments” (and the first package supposedly was free). When it arrived a week later, we weren’t impressed by any of the products. I contacted the provider to informed them I wanted no more, and thought that would take care of things. No, FIP has continued to withdraw money from my account. Except for a phone number that is not always accessible, there is no contact source. Definitely a scam.

I too found myself in a financial bind and had applied for a small loan from different companies. Somehow, Future Income Payments knew of this and contacted me. I ended up "borrowing" $2100 and as promised the money arrived in my account the following day. I was told that my payments would be for $350.....which I have paid for the past 11 months. When I finally got the paperwork sent to me via email, it had me down for $350 for 48 months. I don't know what that equates to in percentage points.....but I'm sure it's more than the 18% allowed by Florida law.....which says in part.....Charging of Florida residents interest rates of more than 18% of the principal is against the law. Also, I never signed any contract, yet on the "contract" my signature has been "printed". I too receive phone calls on my cell phone constantly.....at least 5 a month. "Reminders" that my payment is coming due. I was saving them for awhile - but ended up with so many I finally deleted them. I also received a 1099B for income tax purposes. Why? If there is any Class Action Suit out there that I can join in, I would very much like to know about it and how to become a member.

I too got in a bad financial situation and got a call from DIP and realized that they say this is not a loan but a business and I never got my box that I was charged $599 for and I can't get thru to anyone to ask a question, I get voicemail to leave a message if in a couple of days someone calls me back and tell me I need to contact vi.com and when I contact them they say they never received anything call DIP and I call them and they tell me they have nothing to do with vi.com it's a separate company and the circle continue with no results, so can I get in in the lawsuit?

Is there an early payoff penalty? If an individual rec'd $2500 with a $350 payment for 60 months and after 6 months wanted to payoff the contract. What would the penalty be? What the final payment be?

My husband and I are both disabled veterans. A year and a half ago, we borrowed $5000 from FIP so we could make it through the winter. They have us paying $800/month for 60 months....$48,000! It comes out automatically. Now, I have been going over the monthly account statement, every single on says we are a month behind on payments! which is not possible since every payment has been deducted automatically. This payment is draining the life out of us...We can't keep up on bills and are struggling to make it month to month when we should be taking it easy. We live in Maine...is there a class action lawsuit in our area we can join?

I too was looking for a short term loan and was contacted by FIP. I was also told a could get a loan in one day deposited to my bank account. They deposited $2,619.00 several days later. Once I was able to read the final notice it stated I would be paying $350.00 a month for 48 months to a total of $16,800.00. I was stunned and immediately called them to send them back the $2,619.00. After speaking with a number of different supervisors, they agreed to have me send them back the monies. I need to send them a wire payment thru Wells Fargo and they gave me several options, an electronic routing number and a wire routing number. Would I be eligible to be a part of this class action suit? I would like to know before I send them back the monies.

I am receiving retirement benefits from a disability while I was a Civil Servant in the state Government and I became disabled after a saddle pulmonary embolism. I was on the internet trying to get a loan to catch up with some credit card bills, medical bills and IRS bills. Some how I was contacted by FIP. They told me I could get a loan in one day and that the funds would be deposited in my checking account. I went for their promise that funds would be put in my account. I talked to a couple of fast talking and impatient agents for their company. They had my signature preprinted on these forms and after I got a chance to really read the forms I discovered that they wanted me to pay them $350 a month for 5 years totaling $21000. Plus they tried to get me involved with selling some vitamin products. I received a big box of these and had no clue what to do with them. I am in the process of sending these products back. I talked to a person working for FIP and he said that I still had to pay the $21000. I need help, I was scammed. Is there any relief out there for me. I will pay the $3006 that was deposited in my account, however, I think that it is wrong for them to charge me $350 a month for 5 years. I would like to be a part of the law suit, am I eligible?

I used Future income payments as I receive VA disability. currently on a fixed income. My spouse was very ill and we needed to money for her continued care. She passed away last Month and now these people have started to call and harass me via email as well. I'm not in any position to repay them @ present nor am I in any emotional state to put up with their BS. Would love to be added to this class action as well

I was just assisting my elderly mother in applying for a loan to cover emergency medical expenses and received a call from Future Income Payments. Thank goodness I was here to help her out before she was complete ripped off by these scammers! She was told that she had been approved for a $2500 loan, with 60 MONTHLY payments of $300 totaling $18,000! We asked could we simply pay the loan off within 60-90 days to avoid the exsorbodent interest and was emphatically told NO! In addition they told her that this special loan offer was partnering with a Health/Wellness program called "Vialus" that would send nutrition products monthly that she could opt to sell to help her pay the monthly installments! When my Mom declined the deal, the rep became very nasty stating that $300 mo. was less important than her medical needs! I then took over the call, and well... PLEASE BEWARE, THIS IS THE MOST INHUMANE RIPOFF EVER, PROTECT YOURSELF AND LOVED ONES, DONT FALL FOR IT!

File a complaint with State of Nevada Department of Business and Industry Financial Institutions Division 1-866-858-8951 and file a complaint with State of Nevada Office of the Attorney General Bureau of Consumer Protection 10791 W. Twain Avenue, Suite 100, Las Vegas, NV 89135. I did and now only have to pay what I borrowed which is better than about 24,000 they tried to scam me with for a $2100 loan. I agree to be part of this suit.

My son was medically discharged from the Navy after 13 years. He borrowed approx. $4,000 to purchase a vehicle. They set up auto-deduct from his checking and took his money for the specified 36 months. When he moved on, he started receiving emails and requested an accounting of his account. They refused. Emails continue with a pay-off of over $8,000. Thank God he closed that account! It sounds like this company is a scam that preys on our veterans! Is there a class action available for their lies and illegal practices? I would think that their dealings are nothing short of illegal. I would surely pass any info on to him and his new wife.

I received $4200 from Future Income Payments for a source of income for the summer of 2016 as I am a 10 month employee of our school system. I was led to believe that this was a "short term" loan based on my pension and would have it paid off soon because of a $700 a month payment.

After reading the "small print" I realized that I would actually be paying that $700 for 84 months for a total repay of $58,800.00!!! That is an interest rate of
2398%!!!! Unbelievable deception!!

I would be very grateful to be part of this class action suit.

Future income contacted me on several occasions to offer a loan for $1800.00 at $350.00 per month until that amount was paid in full. The interest was never explained nor was I told that I was actually selling s portion of my disability. They day I owe them $21,000.00. I spoke to them indicting that this was the case. They said ok. Then pay $3,000 and the contract will be closed. They sent email indicating $21,000 still owed. I was lied to since day one of them contacting me

I am a veteran and I have bad credit and was online trying to get a loan to fix my car and pay a couple of bills, I was contacted by Future Income payments a few times offering to wave a$300 fee and giving me 48 payments? instead of 36 to make my payments smaller.
It sounded to good to be true but I was stuck and needed my car ( I am disabled ) so I agreed to their terms $1200 for $300 a month for 48 months. Now I can't pay all my regular bills, soon my lights will be turned off and my cable, internet and phone will be turned off next week. Is there any way I can get out of this agreement? Please help me!

I was in dire need and borrowed 5000.00 dollars turns out they say I owe them 30,000 dollars...how crazy is that..what kind of interest rate is that. I need help to get this resolved

I have made a terrible mistake. I was sick and needed some money, and made a mistake ad signed Future Income documents for $14,000, and I now see that I am on the hook for $140,000 bucks. $1,200 per month. I must have been on my Dialysis medicine when I was Ill for a while, and now I cannot get a clear answer from this company.





I see that New York did some crack down on this company as I noticed,,, where I found this email to you.

I took a loan out with Future Income Payments and got a little over $2000.00 and the want me to pay back $300 a month for 57 months. What is the apr on a loan like that.

I took out 2500. against my pension . I was told that there was a 300 "processing' fee. I was repeatedly told the payment would be 303 for 2 years. Come to find out it's for 10 years. I did not sign the contract, my initials consist of 3 initials, but yet there are only 2 signed.They have called me on a few occasions on my cell phone, which I do not appreciate. This class action lawsuit is not enough. They should be shut down and the people they are duping be refunded their money.

I'm a veteran that took out a loan with future income payments LLC, do to some financial hardships with maintenance repairs to a semi. Unable to obtain another traditional loan this seemed like my only option. I borrowed 22800. My repayment terms were 1250 a month for 48 months. Is there any help for me because of how much money they are making off of me in return.

I took out a loan with this company for 10k
i only received 9700 i was not able to afford my payments i now according to their records owe them $18,000 they call me multiple times per day on my cell phone, they prey on veterans in a difficult financial situation

I've been paying on a cash advance from Future Income Payments, but they've always contacted me by cell phone from the beginning. Am i eliguble ti be part of this suit?
