ADT Faces Employee Overtime Class Action

Employees of the security alarm firm ADT are suing the company, alleging that ADT is in violation of the Federal Labor Standards Act by its failure to pay overtime.

The suit, filed in Eastern Texas on October 28, proposes a class of plaintiffs consisting of service and maintenance technicians, commercial installers, installation technicians, residential installers or installation technicians who were responsible for the installation, maintenance, inspection and repair of ADT devices in commercial and residential security systems for the past 3 years.

The employees allege that they worked in excess of 40 hours per week, and that ADT was aware that overtime was not being paid as compensation for the additional hours worked, and wilfully failed to record all of the time worked.

Additionally, the complaint alleges that in order for employees to be dispatched quickly, they were required to take company vehicles home but were not paid for travel time to and from home or the office or work sites.

The plaintiffs are seeking damages for lost wages, liquidated damages equal to the sum of unpaid overtime, attorneys' fees and prejudgment interest.
