Yasmin Miscarriage Lawsuit Filed—More to Come?

Baton Rouge, LAWhile Bayer is settling thousands upon thousands of Yasmin lawsuits alleging pulmonary embolism and deep vein thrombosis, the drugmaker is now facing a new allegation: Yaz and Yasmin birth control causes miscarriage.

A recent lawsuit filed by a woman in Louisiana Eastern District Court (case no. 2:2013cv05844) comes as no surprise to Yasmin attorney Jason Brown: one of his clients had two miscarriages after suffering a pulmonary embolism. “This young lady’s life plan changed. Instead of a large family, she must settle for one child,” says Brown. As if dealing with such emotional trauma isn’t enough, a number of pregnant women who have suffered a pulmonary embolism and/or deep vein thrombosis (DVT) have to inject themselves daily in the belly with Lovenox, an anticoagulant drug to help reduce the risk of developing DVT blood clots.

“My client had two miscarriages before this child was born and not only would she have to inject herself with Lovenox, it is mentally and physically a challenge bringing a baby to term after suffering a pulmonary embolism and she feels too sad to deal with possibly more miscarriages,” adds Brown.

Keyra knows only too well those challenges. In October 2012, she told LawyersandSettlements that she was “pretty sure” Yaz caused her to have two miscarriages before a DVT was found. She had taken the drospirenone birth control pill for about a year before her first miscarriage and a DVT was found during her third pregnancy. “The blood clot was in my amniotic sac with the baby,” Keyra says, adding that she feels lucky it was found in time. “The specialist determined that the blood clot was pre-existing - it had been there before I was pregnant - so I was put on bed rest for 22 weeks straight to keep the blood clot from bursting and hurting my unborn child.”

Louisiana plaintiff Debbie Caine Matthews started taking both Yasmin and Yaz in 2007. She suffered two miscarriages in 2008 and another in 2011, but did not discover that Yaz may have been responsible for the miscarriages until June 1, 2013, according to the lawsuit she filed on September 16, 2013. Matthews is suing Bayer after she suffered severe menstrual bleeding and several miscarriages from unwanted pregnancies. Because Matthews was taking Yasmin and Yaz birth control pills to prevent pregnancy, she is suing Bayer not only because the huge pharmaceutical company was negligent in its labeling of Yaz, but also negligent in the manufacturing of the product.

Further, the Yasmin and Yaz miscarriage lawsuit claims that Bayer is guilty of false advertising, defective products and concealing information.

Matthews alleges in her Yasmin/Yaz lawsuit that Bayer wrongfully and deliberately did not release the information that the drospirenone birth control pills have dangerous side effects unlike other birth control pills available. She is seeking to recover medical expenses, loss of income, and other damages that were caused by her suffering from using both Yasmin and Yaz.

Miscarriages reported by Debbie Matthews and Keyra and Jason Brown’s client may ignite the next wave of Yasmin and Yaz lawsuits. The FDA has been receiving an increasing number of injury reports over the last several years, including unwanted pregnancies and miscarriages. Bayer has yet to update its warning label to include these sad and unfortunate side effects.
