Unwanted Text Messages Results in $3.5 Million Settlement

Minneapolis, MN: It was just over a year ago that convenience retail giant SuperAmerica settled a TCPA lawsuit brought by a plaintiff representing a proposed class of similarly-affected litigants 175,000 strong. At issue were unwanted solicitations in the form of text messages that plaintiffs claimed were illegal under the Telephone Consumer Protection Act. The lawsuit was brought in the State of Minnesota.

Minnesota Consumer Sues Capital One over 128 Bill Collector Robocalls to Cellular Phone

Chaska, MN: By the middle of 2017, after more than 128 bill collector harassment calls Kristie Drigger had had enough. She sued Capital One Bank in Minnesota District Court, seeking at least $1,500 per telephone call made in violation of the Telephone Consumer Protection Act (TCPA).

Plaintiff Goes After Kohl’s With Proposed Class Action TCPA Lawsuit

Chicago, IL: Imagine getting over 100 unwanted calls to your cell phone. Well, Mark Ankcorn doesn’t have to imagine it. He alleges to have actually experienced such TCPA violations from Kohl’s department Store between July, and October 2014. After receiving upwards of 105 nuisance calls within a four-month period, Ankcorn filed a lawsuit alleging Kohl’s TCPA violations in 2015. The plaintiff has recently petitioned the courts for Class Action certification.

Florida Plaintiff Resolves Citibank Nuisance Call Lawsuit

Tampa, FL: The telephone has, for generations, served as a communications conduit. And while technology has evolved to include mobile, music, video (live and passive) and data, the role of ‘the phone’ has remained largely unchanged, as a modicum of contact. Various forms of abuse, however resulted in the establishment of the Telephone Consumer Protection Act (TPCA), a basket of regulations introduced in 1991 designed to protect against unwanted intrusion. The automated ‘robocall’ from various sectors, including retail and the banking industry, is one of the intrusions the TPCA was designed to mitigate and provides a basis for consumers to retaliate with, for example, a Citibank nuisance call lawsuit when those tenets are ignored.

Settlement Reached in Citibank Robocall Proposed Class Action

For Comenity Bank, TCPA Violation Lawsuit Keep Coming

Chicago, IL: A bank that isn’t really a bank in the traditional sense has been hit yet again with Comenity Bank TCPA violations by plaintiffs who assert the bank’s use of robocalling and other, allegedly unlawful methods of contact amounted to undue harassment and flies in the face of regulations governed by the Telephone Consumer Protection Act (TCPA).

Months-Long Investigation Uncovers Potential Consumer Data Misuse in Florida

Tampa, FL: While there are various federal laws in place designed to protect the privacy of the consumer, including misuse of phone numbers and contact information, an exhaustive investigation by electronic journalists in the state of Florida has uncovered a practice whereby private driver records are vended to various companies in exchange for payment to generate revenue. The result: consumers are inundated with marketing ploys. It only adds to the frustration already generated by nuisance calls.
