Sears Peeping Tom Facing Class Action by Female Victims

Hollywood, CAIf you shopped at Sears in North Hollywood, CA, during the past three years – you may have been videotaped by the Sears Peeping Tom. A group of 25 women have filed a class action lawsuit against the retailer claiming that a former maintenance worker videotaped them while they were in the dressing rooms or restrooms at the North Hollywood Sears, between 2009 and April 2012.

Arrested for burglary and surreptitious filming of unsuspecting women on April 12, 2012, Alejandro Gamiz, the 27-year old maintenance worker who allegedly committed with crimes, worked at Sears for seven years. During that period, the lawsuit claims Gamiz placed hidden cameras behind the walls of the store. Gamiz posted $20,000 bail and was released from custody, and so far the case remains under review by the Los Angeles District Attorney's office, it has not yet filed charges against him.

According to a report by ABCnews.com, 16 of the 25 women who filed the class action are employees, and the remaining nine are customers. The group filed a lawsuit against Sears on June 11 claiming that Sears either knew or should have known that Gamiz had installed video equipment and created peep holes. They are suing Sears for invasion of privacy, intentional infliction of emotional distress, hostile work environment harassment, and negligent hiring, supervision, retention, among other charges.
