Fen-Phen Lawsuits and Settlements Revisited

Charleston, WV“I used to work in a prosecutor’s office and like to keep up on legal news,” says Patricia, age 65 and a former Fen-phen consumer. “I subscribe to the LawyersandSettlements newsletter and that is how I discovered that you could re-open a Fen-phen claim—even if you settled. But I never filed a claim to begin with. I thought it had been completely settled-- now I am totally surprised.

"I think that most people who settled years ago for a negligible amount would also be surprised to know that they can re-open their claim. A lot of people my age don’t have computers and don’t know what is going on.”

There are two Fen-phen “camps”: those consumers with minor injuries who originally settled with Fen-Phen drug manufacturers and those who had no Fen-Phen side effects and did not join a Fen-Phen lawsuit. Now a judge has ruled that both camps may be eligible to file a claim.

“When the Fen-phen lawsuits settled, people thought the injury had a time limit but over the course of time injuries continue to occur,” says attorney Ben Stewart. “If you originally settled with a minor injury, and have now developed a serious condition, you can file a claim. Or you didn’t have an injury and didn’t settle, now you can come back and file a claim.”

Two recent lawsuits argued that Fen-phen consumers developed PPH several years after using the diet pill. Wyeth Pharmaceuticals (the company that invented the drug) attorneys argued that the cases should be thrown out because the plaintiffs had no evidence that Fen-phen could cause PPH more than a decade after the pills were discontinued. The judge disagreed. In September 2012, Judge Bartle ruled that Fen-phen lawsuits involving latent Primary Pulmonary Hypertension (PPH) will be allowed to proceed.

Judge Bartle determined that enough scientific evidence supported the latent PPH argument, which is extremely good news for the plaintiffs and countless other Fen-phen users who are now suffering from life-threatening PPH, a severe lung disease that causes progressive lung and heart damage, and often leads to heart failure. There is no cure for PPH.

Even if you took Fen-phen back in 1997, like Patricia and her husband did, and are just now developing symptoms of PPH, you may be eligible to file a Fen-phen lawsuit. Patricia is filing a Fen-phen claim on behalf of her deceased husband and herself. They both took the Fen-phen diet pill for about two years.

“My husband, Delbert, had open heart surgery in 2001 and had six bypasses and now I too have heart disease,” says Patricia. “Neither of us had any signs of heart disease before taking the drug so I really think that Fen-phen contributed to his death, and now I am facing Fen-phen injuries.”

Patricia, who had a stent implanted several years ago and is now on heart meds, doesn’t remember getting any information about the side effects or risks when they were prescribed the drug to lose weight.

“We both started having heart palpitations so we stopped taking Fen-phen on our own because we thought it wasn’t good for us—our doctor didn’t advise us to stop taking it,” Patricia adds. “I remember that it took us about three months for our hearts to stop racing, to get it out of our system. We thought we were out of the woods but that wasn’t to be.

"Delbert began to have chest pains and we got him to a cardiologist. They found the blockages and said he needed surgery immediately. It was a shock to both of us. At that time we never made the connection with heart disease and Fen-phen--you just accept what the doctor tells you and you just carry on.

"We had gotten a letter in 2002 from “Pounds Away”, a weight loss clinic where a doctor prescribed the Fen-phen but we ignored the letter because we weren’t having any problems back then.

"When my husband passed away last year I began to clean out our paperwork and found the letter. They wanted us both to come in and arrange for us to be tested for hidden heart valve damage and Fen-phen related PPH. But I never received any information pertaining to a Fen-phen lawsuit.

"There are days when my heart races. I think that I would have had a heart attack and probably wouldn’t be here either if not for taking heart meds and being under the care of a cardiologist. I take care of myself and watch what I eat, I exercise daily: I walk and use the treadmill and if I get the chance, sit-ups and other exercises. I never drink sodas and limit coffee to two cups a day. I don’t eat any red meat and don’t drink. I’m feeling pretty good but I am still dealing with my husband’s death—I really believe he would be here today if not for Fen-Phen.”

I was diagnosed with regurgitation heart value do to taking Phen-Phen, I like some I was reading received some money as low as $150.00 and the highest being $6000.00 but I have not heard anymore about the class action suit. Last I heard was the the case was closed and the attorneys who held the cases took off with the funds that rightfully belong to the patients who were expect to be getting a settlement.

How can I find out anything about my claim, since all the paper work I have is outdated.

I a 60year old female I won a class a lawsuit several years ago they put my settlement in a escrow then they took it back I proved the damage that dampen did said since no surgery in 10 years the the reason can I get it back

This has to be the weirdest of all things weird. I am in a law class we are doing torts, so I figured I would use one I am familiar with because I have heart valve damage from fen-phen. And had I not looked here I would have never known, I was told they would pay for the testing and they took $12G from the settlement I got about $5000, after legal fees paper clips and what ever else was taken. My legs and feet swell, I'm always sleepy.. So now what?

I started on Pondimon on 6/19/96 and within 3 months, I started to have breathing problems. My doctor took me off this medication in mid-Sept. '96 "for safety sake." It was too late. My first echo was done on 10/26/96 and showed moderate mitral and tricuspid valve regurgitation. I became part of the class action lawsuit, with many more echoes being done showing the damage done to my heart valves. I did get a small settlement after about 8 years. A right-sided cath. was done in 5/09 which revealed that I also had Pulmonary Hypertension. My mitral valve has worsened and worsened over time to a point of being severe mitral valve regurgitation that has caused pulmonary pressures of 80-85 mm hgs -- dangerously high found by a Dobutamine Stress Echo done in May 2017. Also, the faulty valve has caused Diastolic Congestive Heart Failure on top of everything. Upon the findings from the Dobutamine Stress Echo, I was immediately sent to a Cardiac Surgeon and will now be undergoing major open heart surgery to repair the severe mitral valve situation on 6/15/17 because they must get my pulmonary pressures down, or I will die!! When I was diagnosed with the PH in 5/09, an attorney took this case on in 4/13 with another fen-phen lawsuit. I was told that this lawsuit would not take as long as the mitral valve lawsuit did because I was already part of the Trust. I gave approval to the attorney who handled my mitral valve litigation to release my mitral valve records to the new attorney. I was told by the new law firm that "it's not if, but when this lawsuit settles." I have kept this new law firm updated on everything that is going on since the took my case on. I was never updated on anything by this law firm as to how my case was progressing. I sent them an email on 6/6/17 after meeting with the Cardiac Surgeon to let them know of my upcoming major heart surgery. I receive an email back telling me that my PH lawsuit had been closed. I was shocked -- at no time sine 4/13 have I ever received anything from this law firm. They had this case for 4 years and now tell me that I cannot do anything further because of time. I was very much aware that I could re-open a case after my settlement if my situation worsened to the degree it has today. This Pondimon destroyed my life. I have had no quality of life whatsoever for many years, and now I am told by this attorney that I am barred from pursuing this further because of time. I believe that my case was closed a long time ago, and this law firm failed to inform me in a timely manner so that I could have pursued this further. The settlement that I got from the mitral valve class action was miniscule compared to the money that I have had to expend dealing with the damage this drug has done to my heart and my lungs!! How much more are we victims of this medication have to incur, financially, physically, and emotionally, as a result of a very dangerous drug that the manufacturer failed to pull off the market before so many lives were intentionally impacted??

took phen phen in the 90s.Was diagnosed with mitral valve damage.Settled for 6000.00 now I have lung damage and on oxygen 24 hours a day.heart goes 90 miles an hour and irregular beat up in age now.but was still active befor phen phen.It took everything away from me and ruined my life.

My mother took this stuff in the 90s. It messed her up really bad to where she is pretty much crazy. Used to believe the cops were following her. Then the government. She is paranoid and talks to herself. She can function in day to day activities like cooking and cleaning. She also believes that my kids with my wife are actually with my wife and my dad. They are not.

She was a great loving mom then she took this stuff and just went into her own world. My dad ended up divorcing her because she refused to see a doctor.

Does anyone know any good lawyers to open a lawsuit? We never tried to sue before but after talking with family they said it could have been fen Phen. Has anyone experienced something like this?

I received refund for rx, in 2013 I was dx with PHD, (Pulmonary Hypertension Disease)and required 3 stents in heart. Contacted attorney who said it was too late, had to have file green form at original notice to be considered. I took redux and pondimun , I worked for a group of doctors and drug reps gave several of us free pills. We had to have Dr. Rx and purchase before we got free, but no warnings. I took the pills for about 8 mos starting in 96/97. I have medical restrictions now because of my breathing.

I never knew about the Fen-Phen Redux Settlement and I took it from 1995 to 1998. Fen-Phen was also in Dexatrim. So what should I do now?

I took the diet pills after I gained so much weight in 95. Had A lawyer in Charleston West Va. Took my deposition and never heard from them again.pretty dirty, had 5 heart attacks and died 3 times, was taken to St. Mary's in Huntington, West Va. On my record that I was A heavy cocane and Crack user. Have never seen either of these.had open heart surgery in 98.Never heard anything from my attorneys, guess they got my money.

I was in the original lawsuit and received 23000. I have since had several tumors removed and one massed in my chest wall. Now is about to go back cause it's trying to come back. I think this is still coming from me using the phen phen years ago. I need to re-enter the lawsuit.

Both my husband and I took Phen-Phen/Redux in the late 90's. I have a heart value problems. both of us have high blood pressure, my husband had a TIA stroke. Wondering who I need to contact since its been a long time since we've heard anything. I received a small amount of monies but haven't heard anything else since i received the monies in 2002. Was also wondering how much monies the lawyers who was handling the class action suit. Because like another writer stated we don't get enough monies for the amount of pain and suffering we are all going through now. Sad but true!

I added my name years ago for the lawsuit. Now my doctor is saying I am a high candidate for a stroke or heart attack. I might even still have one of the bottles. I've never heard a thing and have no idea what to do.

With all the comments, You would think that some Attorney would try and help all of us that settled out of the class action, and would file a new suit for all of us having new problems today. I too was wondering if people who settled in the 7th were going to have a chance to get what I was originally entitled to. I do have serious panic attacks (did not realize at time related to mvp.) I was a nurse, and am now on disability. I also have major hand tremors, and at times feel as if my body is shaking inside. Don't know of many patients willing to allow me take care of them. Now because of their drugs I will never work again. Is there anyone who knows if we still have any chance of cases being re-opened, or new ones starting. Any input is welcome. I too have moved, and with new phone #'s. Unsure if my lawyers were trying to contact me.

I also wouldliketo know what the laywer firm that handled my case got as well. I know what they gave me, which didn't seem like enough fir the damage done. My mitral valve was damaged from the phen-fen drug. I also wouldlike to know if more money was paid out on my behalf that i never got, and if i qualify for more. How do we find these things put and what my,part of the settlement was before the laywers took their part???

I took phen-fen in the late 90's. Shortly thereafter I was in St. Thomas Hospital under the care of a cardiologist & con-
tinue to be to this day. While I was in hospital, I was watching the news & they were just then reporting the suspected problems associated with taking the drug. I entered the class action.~~Thank goodness! I did receive a settlement in 2001 (the paperwork work was overwhelming & also, trying to compile all the medical info~~but I did!). In 2006 or 2009 I received another check where they determined that they had paid the lawyers too much. This past week, I received another letter from my 'class action' attorneys informing me that there is additional monies to be had. I have all of my paperwork because initially it set forth that the class action would end in its entirety in 2017, so they are probably trying to distribute the leftover funds. Yay!

I took phen phen in 1990-1991 and year found out I was pregnant after taking the med for months. Years later when my son was in his teens found out he had heart disease which reconstutive surgery was conducted in 2006 which my.l just want to see if phen phen was the cause of heart disease.thanks

I was not aware of the lawsuit (moved a few times when it started) I only found out about the it late last year (2014) when speaking to a co-worker about it. Did some research and found this site. I took it in 97 for a few months and now I have high blood pressure and other issues. I don't even know if the Dr. that prescribed the med is still in practice. I hope there is an attorney in Houston, Texas that can help with this.

I want a lawyer to take my case and file a suit on PPH . That is different then what we settled for with heart valve problems and replacements. Now have a ICD, Atrial Fib, HTN, pph. You name it I have it. There has to be some one to help file this new suit.

I literally just received a phone call from a woman from a law firm asking me if I had any side effects ,specifically Mitral Valve Prolapse & I said no...unfortunately the # came thru as Private Caller....
But luckily I kept my file from 2002 & looked at my medical reports & see that I do have Mitra Valve Prolapse

I settled with the phen fen diet drug settlement.i opt out getting around $4,000.00. I tested positive for aortic mitral valve something, now i have high bllod pressure. Aneurysm in my aortic valve. Panic attacks. Rapid heart beats. Does anyone know if i still qualify for compensations, although i've opt out.

The first time around, I couldn't pay for the tests the attorneys wanted, but no one ever sent me anything to say I could get them and they would be paid for. Then attorneys involved said I couldn't prove heart valve problems so I was dropped.
Then this last fall, another message from a different group of attorneys who wanted my medical records. Neither the Dr who filled the prescriptions, nor my insurance company at the time has records that far back (90"s) and the pharmacy I used is out of business so just where would those records come from that far back?
In 11/97 I was hospitalized with a serious blood clot........and somehow got those records..........but they sure don't mention fen-phen.............only extremely high blood pressure. And the icing on the cake? I was recently diagnosed with white matter disease of the brain that they are thinking came from my blood pressure being so high.

I am in this lawsuit.. And still waiting to see if anything will ever come of it. I have heart valve damage. Recently was diagnosed with heart disease and have blocked arteries also. Not sure if this stems from the meds I took years ago or not. But an end to this neverending lawsuit would be really nice.

I believe my father died because of this drug,he showed me a bottle of the drug and said he was in a lawsuit but he died before the settlement, we haven't heard a word or received any information since.

I was never involved in the first go round, wasn't having issues then. Now that I am, I'm ready to join a class action if there is one going. Please post info on here if someone knows who to contact.

Just thought about it while speaking to a co-worker who mentioned his wife had received a settlement over 10 years ago. After discussing the forms and specifics with him, I believe it to be the same suit. Where can you get information on this?

When I filed my claim I received correspondence that I could possibly receive $ 400,000 based on the results of my medical records. Later I received notification that due to the number of claims that had been paid the funds were not available and that a certain amount was going to be divided among the claimants. I eventually received approximately $1500. Does this sound like I might have a claim now? What should I do?

With everyone responding to this. There should be a Attorney that could help all of us go back and get what we are in title to for the damages it has caused since we settled under the lies by the AHP. We all have the same stories and situation. None of us knew that the problems would keep continuing on. A new class action is needed or our cases looked at again. But something needs to be done. I just do not know how to get the help.

I also took phen fen and my lawyer told us all it was in our best interest to opt out or we may not recive any compensation and we accepted a settlement. Since then I have had open heart surgery with a mechanical saint Jude valve and I am in and out of the hospital I never received punitive damages and felt like I was done wrong ,we had 13 in our group I was told and if we didn't take the offer it would be off the table the next day. our case was in pennsylvania and I even had to pay back my medical insurance company back all they paid out for my surgeries ,@ $300,000 or my attorney said they would tie up my money in court if I didn't go ahead and allow them to pay them from my settlement. I was also paying my own medical premium for this insurance. After all was said and done along with charges for another attorney that spoke to me maybe two times on phone while he was running for a senator but lost and got paid $150,000 from my settlement for being a consulting attorney.
If anyone knows what us little guys can do before we pass on please let me know. My attorney wont even return my email or call on it so I just gave up until I read these post of people like me that was mistreated. Thank you all and God Bless you and yours.

I took phen fen for about 3 years.Had a substantial settlement and had to sign off saying case closed.My attorney got a big part of it.I'm having to see a cardiologist now lots of problems including heart valve surgery.My claim was settled in Texas and those original attorneys don't even want to discuss it.I don't know any details or what my claim number is.Does anyone know what to do?

My sister was diagnosed with Cardiomyopathy, she weighed 400 pounds and the Doctor's said she had to lose weight for a heart transplant, she lost the 200 pounds without Fen Fen, She returned back to the Doctor's and they said her heart was working a lot better since she lost the weight and didn't need a heart transplant, but she was not to ever gain the weight. Well she did start gaining the weight back, then a doctor prescribed her Fen Fen, she took the drug for almost a year. She died of a massive heart attack sicx months later, she still had the fen fen in her pocket book, she left behind a 13 and 16 year old son and sisters and brothers that loved her very much, can I file am law suit

I took these diet drugs for about 3 months in the late 90's. I received a small settlement in 2006 . I have a letter from the attorney saying if I had heart surgery within so many years I would receive another $100,000. Thank God I haven't need surgery but WHO GOT THE $100,000? I called the attorney's office to ask but couldn't get a straight answer. Does anyone know? I'm thinking about re-opening case.

Yes CW Sweeny the same thing happened to me and I am still fighting. The best thing I am going to do is continue to fight I know my lawyer did me wrong but the statue of limitations for the bar association to do anything about it has expired.

Just saw TV show re greed and fen-phen settlement. How can I see what the manufacturer agreed to pay on my claim - I know what the attorney gave me. I was awarded a sum to be used for surgery within a limited time period and if not used the sum disappeared. I assume the law firm got it. Has anyone else had the disappearing medical award with time limits? I never got this medical award because I have not had to use it to date. I did receive a separate award for damages to my heart valve.>

Jill and everyone, I read your comment and I believe we should start a class action lawsuit against the Attorneys that may have done to us what those other Attorneys did and kept most of the settlement and lied to us about our actual settlement amounts. Those Attorneys are in jail now. We need a lawyer who will represent us and go after the truth.

If you have someone have them contact me and I will have an attorney that I find do the same thing. I have had open heart surgery and received less than 10,000 dollars

I did receive a settlement not in the class action, but by a private attorney that advised us to take the settlement. I did not know that I would keep having problems still to this day. 3 open heart surgery's, Going into Cardiac arrest. Or I would of never settled knowing this could still happen. And the cost still to this day . It sounds like to me from all the post we need to find a attorney that would take on all our cases again and go after them for the things that have happened to all of us, over time. I have been looking for a couple of years now and the Attorneys only want the ones in the class action. If any attorney is reading this, I think all of us need help, to make this right. American Home products knew that there would still be problems, but did not tell us in the settlement. That is why they covered them selves in a clause( known or unknown.) I have learned a lot looking into this. If anyone has a Attorney that is willing to help please let me know, before I die. Thanks

It's good to know that fen-phen users haven't lost their ability to sue just because they weren't suffering from PPH or valve damage at the time of the original settlements.

I do wonder about some of the reader comments though. It's possible that fen-phen caused other problems, but I thought there was only a chance of winning a lawsuit for PPH or the particular type of valve damage fen-phen is known to cause. Not strokes, other types of valve or heart damage, fibromyalgia, tremors, afib, etc. It would be very difficult I think, even impossible, to establish that fen-phen caused those other problems.

I received settlement in 2007, took the drug from 1996, in 2006 I collapsed while grocery shopping and was diagnosed DCM, TIA, mitro valve prolapse & afib...wanted to know if this constitutes additional compensation from class action suit...I am registered claimant.

My husband took this diet supplement in the late 1990 and has suffered from neurological problems from the stimulation of the brain, insomnia, and stimulants in this product.. We have been involved with a suit some years past for a small amount of heart damage through a lawyer in Texas. We have suffered from essential tremours for more than 6 years now and currently will be going to MAYO this week for updates on his condition. He is unable to shave himself, feed himself, and wirte.. for a retired school teacher this is rough. Please let us know if anyone has determined these supplements to cause such neurological damages thank you,, Barry's wife, Deb

I was diagnosed with mitral valve prolapse, and I'm really scared that a recent Dr's visit was not as thorough as it should have been. A friend's husband had those so called professional tests, and he ended up with a misdiagnosis and is now bed ridden, and she has been up in arms, etc.etc.,. and you would think this could not have happened to him, but it did. What should I do to make sure I am getting diagnosed correctly with regard to my over all health after taking this drug, or drugs? Thank you..... FH

I took phen fen and my lawyer told us all it was in our best interest to opt out or we may not receieve compentsation and we accepted a settlement. Since then I have had open heart surgery with a mechancial valve and I am in and out of the hospital.

I took pfen fen for about six months. Ten years ago I had gastric bypass surgery (it worked!). During all the testing prior to having the surgery, it came out that my heart wasn't in the best of shape. I never thought anything of it, just knew I had to get the weight off. Long story short, three years ago I suffered a mini stroke (TIA), which turned out to be one of 3 that I had had. Since then I have been diagnosed with cardiomyopathy, leaky heart valves, atrial fibrillation and an enlarged heart. My cardiologist had told me I would likely be on a heart transplant list in 2 years if my heart function didn't improve dramatically. Am doing better now, managing my conditions with medications. Now I have to wonder if any of it could be related to pfen fen. Any suggestions? Thanks!

I used Fen Phen for about 6 months. I stopped b/c my heart kept racing. But I didn't have any problems until last year. Now I have high blood pressure, panic attacks and recently dx with mitral valve prolapse. What can I do?

I never received any settlement because my doctor quit her business and I could not get my records showing what she dispensed from her office. Do I have to go through an attorney and pay them??? My mom went to the same doctor but she got benefits...

I took redux way back in 96 to 97. Back then the heart test cam back ok. But now I have had problems with my heart racing, anxiety attacks and fibromyalga since 97. Now I have high blood pressure for the last3 years or so. I tought I was a part of the law suit but I never heard any thing. Can someone guide me in the right direction? Thank you.

I received a settlement maybe somewhere around 2000-2001. I would like to know the amout of my settlement recieved and I belive it was with a law firm in Charlotte, NC.
