Santa Clara, CA In the third hernia mesh bellwether trial in multidistrict litigation, C.R. Bard and Davol Inc. were ordered by a federal jury to pay $500,00 to a Maine man who claimed his hernia mesh caused pain and other complications. The jurors found the company liable for failure to warn, strict liability, and negligence but Bard was off the hook for any punitive damages.

Santa Clara, CA In response to a multitude of hernia mesh adverse event reports, the FDA published new information in July about the risks and benefits of hernia mesh surgery. The agency gives non-surgical options and advises that patients should obtain certain information “If you have post-surgical problems”. It would seem like the FDA has made a hernia mesh mess.

Bard’s request to replace the final two bellwether hernia mesh injury cases previously selected for trial, arguing that the claims are no longer representative of other claims pending in the litigation, were denied by U.S. District Judge Sargus. Bard’s reasoning is that plaintiffs’ injuries have worsened since filing their complaints: pain has advanced to severe injury.

It joins 12 lawsuits pending in federal court and more than 140 state court cases all alleging Parietex Composite hernia mesh is defective and prone to failure. It results in patients needing revision surgery after suffering painful hernia complications, including severe adhesions, organ perforation, bowel obstructions, and infections.

Silver Spring, MD The FDA reviewed Boston Scientific’s latest studies of the pros and cons of using transvaginal mesh to treat pelvic organ prolapse (POP) and doubled down on its earlier conclusion that the risks outweighed the benefits. In 2019, after a spate of surgical mesh lawsuits, the FDA ordered Boston Scientific to immediately pull its transvaginal mesh products off the market.
