Four File Suit over Wrongful Deaths Allegedly Caused by Fentanyl Patches

Clarksburg, WVFour lawsuits were filed in federal court against drug manufacturer Mylan by people claiming that fentanyl patches were responsible for the deaths of their family members, reports the West Virginia Record.

span itemprop="image" itemscope itemtype="https://schema.org/ImageObject" style="display:block">The claims were filed in the US District Court for the Northern District of West Virginia, which is the district covering Mylan's headquarters. Plaintiffs include Beth Oliver of Florida, Stephen Rosenberg of Colorado, Rose Ann Mowery of Ohio and Jeffrey Winters of New York.

All the plaintiffs claim that the fentanyl patches released too much of the pain-killing drug into their loved ones' bodies and killed them. They also all allege that the overdoses were caused by faulty patch design rather than by failure on the part of the deceased to apply the patches correctly.

"The patch is unsafe for its intended or reasonably forseeable use because it can and does cause lethal levels of fentanyl in patients. The Mylan defendants knew or should have known that patients were receiving lethal fentanyl doses from proper use of the patch because of wrongful death lawsuits filed against them, from the FDA's adverse event reporting system, and adverse event reports from medical examiners and the World Health Organization," the complaint alleges.
