Wrongfully Terminated after 24 Years on the Job

Lakewood, CADarren worked 24 years at a large grocery store, until he was allegedly wrongfully terminated last week, which he feels is contrary to California labor law. To make matters even worse, he wasn’t given a reason why he was let go.
“I’m depressed, my nerves are shot. It’s a bad feeling. It’s a tough time in your life to look for gainful employment at my age,” says Darren, age 53.


Darren is racking his brains trying to figure out why we was fired. Could it be the recent few days of sick time he took? Or a month ago, when he had a panic attack at work? Darren thinks the reasons are more insidious and they are violations of the California labor code.

“I believe I have been let go because of my age, and because I have been here so long; I am one of the highest paid,” says Darren, who was a co-manager of the store. “As well, I have been discriminated against. I am Caucasian and my bosses are Hispanic.”

And the grocery store could also be in violation of the labor employment law regarding misclassification. For the past five years, Darren was assigned a position in marketing away from the store where he didn’t have control over supervision.

“I held that position until I was terminated in August,” Darren explains. “Right before I was fired, my supervisor said they were sending me back to my original position at the store. I had stomach issues so I left work on Thursday and called to tell them I was going to the doctor on Friday, and I provided them with a doctor’s note.”

A month previously, Darren had the panic attack that caused him to take a week off work. Again, he provided a doctor’s note. And another incident happened. Darren had a conversation with a fellow worker and asked if her relative at Safeway was hiring. Apparently Darren’s manager got wind of this conversation and hauled him in to HR. The manager was also in the HR office.

“They had decided that my employment was terminated,” Darren explains. “I asked why. He said he was not privy to that information. They had my check ready, which included vacation pay but I wasn’t paid for my remaining sick leave - 120 hours. I was shocked, and I’m still in shock. I don’t have medical coverage or any income. I was making about $75,000 and now I am on unemployment insurance, I’m having to apply for Medical and I can’t pay the mortgage on unemployment. It is such a hardship on my family - which I have to support.”

Darren doesn’t think that anyone is going to offer him a job at this salary, and at his age. “And who knows what information they will give out if a potential employer calls. If I put my supervisor down for a reference, I don’t know what he is going to say, but it is the only reference I’ve had in 24 years.”

Darren was looking forward to retirement in seven years. Darren is hopeful that a California labor lawsuit will get his job back, or at least some financial compensation.

I was wrongfully terminated by safeay store # 2870 i was very sick and had virus and was out for few days store manager decided to just terminate me the next day and claim it was job abandonment when i was very ill with a virus and i have copy of my doctor note but store manager didnt care and they wouldnt even give me a copy of my termination nor did they ever notified me that i was terminated i found out through HR when my account was disabled from the direct to hr website from safe way thanks store # 2870 you fucked up and terminated me when i was very ill and wouldnt let me explain my self of why i was out for a day and you decided that it was fair just to terminate me in 1 day

IN JULY I Feel I WAS WRONGFULLY TERMINATED WHILE ON SICK Leave! I received a letter that stated they felt I no longer wanted to work there anymore. I never said anything even close to that!! I only needed 11 months for retirement and have had numerous disabilities from a car wreck in 1994 but always did a great job and got excellent yearly reviews! I was forced to withdraw all my retirement money to survive and also have had to apply for social security disability with benefits. The way they went about it was totally unjust because they've always known my situation?!? It will always be hard to get even a part time job from now on as well! I feel they considered me a liability and didn't want me to retire and pay until my death.. Please help if you can?!?! It's vital to me and my family that somethings done and carried out for Justice to be served!! I worked over 19 years for the City of Jasper Tx.. Thanks!
