Fired without Cause? Appeal!

Sacramento, CALou Ron's boss wanted to fire him but he couldn't think of a reason that would satisfy the California labor law, so he was fired for misconduct. Fortunately for Ron, his scheme backfired, but it isn't over yet.

In November, 2005 Lou Ron pulled into a gas station with a co-worker, both wearing their white painting overalls. He was approached by the executive officer of New World Industrial Coatings, and asked if he wanted steady work at Santa Rosa junior college. "I told him that I needed to finish the residential job I had," says Ron. "I called him a few days later and he told me to show up for work in one week."

At the time Ron was living in Santa Rosa and working as a journeyman painter but he didn't have any work lined up, so he jumped at the chance, even though it meant relocating to Sacramento, where New World was based. Ron was promised to be reimbursed travel expenses and $70 per diem, tax free, until he found an apartment, so he packed up and moved to Sacramento with his girlfriend.

"We drove to Sacramento right away and started to look for an apartment. The first day we arrived, the executive field officer came to my hotel room (200 miles from where I live) and said I had to work the following day otherwise I wouldn't be able to work with the company," says Ron. "So I worked the entire week and lived in the hotel. I worked on various jobs in the area, all more than 70 miles away and not once did I get any travel time." At the time, Ron didn't have a driver's license as he had a DUI seven years prior but it wasn't a problem as the other painters car-pooled. He was never required to drive and told his employer the day he was hired about the DUI.

Ron got his first paycheck minus any travel expenses or per diem. When he asked about getting compensated, he was told that "If you want that money, you won't be working."

Shortly after that incident, "We were working at a high school in Sacramento when the president of the corporation asked me if I wanted to buy his truck. I said I couldn't and a few days later he left a message on my phone telling me this was my last day on the job and my check would be in the mail tomorrow. I couldn't believe it!

"It took a week to get paid, still without my expenses reimbursed. I called the office manager and she told me that nobody gets travel time or expenses. I calculated they owed me $1,500, not even taking into consideration the expense of moving here. They promised me work and brought me down here only to cut me loose. This guy is such a chiseler, and it's not just me he screwed; here's another promise that wasn't kept: he wouldn't pay any of us for exotic coatings - we were supposed to get paid about $2-3 more per hour, but he would only pay regular rates right across the board, even for specialized work such as this.

I've been a painter for 15 years and do good work. I have never been reprimanded, either verbally or by letter, but I was fired for misconduct. I started to get unemployment checks but after a few checks I received a letter, telling me that I had to contact my unemployment office. My employer had said that my work was sub-standard and that I didn't have a driver's license.

But Unemployment determined that I was not fired for misconduct. Rather, it was for other reasons, which didn't have to be determined. But this guy, the president of the company, appealed their decision because he didn't want to pay part of my unemployment.

So we went to court.

I went before the administrative judge in California but nobody was there representing the company. Instead, they just sent a declaration stating misconduct claims, saying that 'The claimant was told he had to have a driver's license and he performed unsatisfactory work. He is not entitled to unemployment benefits if discharged for misconduct.'

At the end of the hearing, and 10 days later, the judge from the Sacramento office of appeals found the following:
The claimant was never told that he needed a driver's license nor was there any reason that he needed one. There was not a breach of duty. There is no evidence that the claimant deliberately failed to work up to the standards required by the employer. There is no evidence the employer counseled the claimant about work or work performance. Instead, the evidence is that the claimant was praised about his work. His subsequent discharge was for reasons other than misconduct.
So I received my unemployment benefits. But I am still entitled to more. This guy has to reimburse me. And then some. The best thing this guy did for me was to appeal."

Are promises worthless? Ron was fired one week before Christmas - for no reason other than that he wanted to be reimbursed for expenses.

Hola estube trabajando para una agencia y me despidieron por aserme el test de droga el primer salio negativo l inconcluso y me pararon y 15 dias despues me pidiron aserme otro el cual salio positivo y fue a me despidieron pero ubo casos donde personas se negaron a aser el test y no fueron despedidos y unos q también salieron positivos no los descanaron lo cUal veo una injusticia

Soy víctima de despido injustificado trabajaba duro para salir adelante ahora en las piscas el supervisor me dijo que sería el proximo mayordomo ok así quedó . Derrepente Ami compañero y Ami nos separo viendo que asíamos buen trabajo nos puso que personas que.no querían hacer nada
Con tal que nos empezaba a ostigar la historia esta larga. Solo terminare diciéndoles que tengo la prueba de esto el me quiso dar un warning sin ningún motivo , razón , base ni fundamentos que acredite que yo tengo ganado un warning señores esa persona que se dice llamar supervisor no supo ni que me estaba diciendo a la hora de quereme dar un warning, le dije que se lo firmaría en frente de los patrones el lunes y demás supervisores para que me dijera cuales eran mis faltas u dijo que no tu fírmale y después hablas con quien tú quieras me dijo , y le dije que no tengo por qué firmar algo que no me e ganado, y me dijo ya no hay más trabajo para ti entonces . Me corrió, me dieron el número de el supervisor de el salió más vivo, yo le dije a él mira pasó esto h me dijo que estaba en investigación cosa que era totalmente mentira , mi supervisor le dijo a el que yo le avía gritado como loco y que les dije que no volvería a trabajar más en esa compañía y me dijo que el lunes vendría a mi ciudad a aclarar eso pasó lunes martes y yo le llamaba asta que le dije voy a hablar con este supervisor no pasaron 15 segundos y me marco , casi para amenazarme y cuando fue a hablar conmigo no supo que desirme y me dijo que yo avía amenazado a alguien de muerte por dios que escudas tan estupidas con todo el respeto y que si yo hacía algo pos me iva ir más mal a mí me dio el trabajo para atrás con una persona muy abusiva como mayordomo sólo dure como 3 días y desde allí no tengo trabajo y no sé qué hacer soy padre soltero pago mi propio apartamento que ago y todavía burlándose por a verme corrido noble que hacer ya estoy más endeudado y mi hijo come viste y calza..gracias por su atención .

En mi trabajo cerraron el turno De La tarde y a todos los pasaron a La mañana, Pero a mi me descansaron Yo pienso que porque hace poco me hicieron una ileostomia y asi No puedo buscar trabajo,puedo hacer algo?

Necesito ayuda en español me despediron de mi Trabajo despues de 6 años trabajando para la compañia el problemas fue con un manage quee tenia 2 Dias trabajando en la compañia me acusa de averlo amenazado y eso es metira

E trabajado.Por 9años.en una company de transportes tube un accidente inboluntario me quitaron mi puesto me rebajaron el sueldo y me pusieron aser limpieza .ellos me dijeron que me ponían en provatoria por 6 meses siempre fui muy profesional en mi trabajo de chofer de camiones y ahora me entregan una escoba y 4 Dolares menos de mi sueldo .me siento utilizado .y como represalia para mis compañeros ojalá me alluden ..gracias

trabaje en viejas casino alpine california durante 14 anios somos o eramos 4 empleados en el segundo turno para todo el casino, fui despedido por tomar- mi lonche-mi otros companieros ya lo habian tomado , fuimos 3 trabajadores ese dia ; 2 hombres y una mujer,ellos dicen el (casino) las LEYES FEDERALES Y ESTATALES DEL TRABAJO no se aplican aqui, pues son una NACION SOBERANA creo que va incluido el CASINO tambien; ha de ser la razon por la cual se comete tantas injusticias.fui ARROJADO del casino a las 9:25pm el 24 de octubre de este anio. causa de despido: INSUBORDINACION y todo por tomar mi lunch break.

Yesterday I was fired from my job, they said they need to do changes around the warehouse and that my position doesn't fit in those changes any longer, at the end of this month I was supposed to get a bonus and they didn't give it to me, besides, they over paid me a few months ago and I still owe them money, they said they will call me to arrange payments. Another thing: I had some unpaid personal time off that they didn't paid me either, what are my options? Thanks

Trabajaba en el campo , un dia normal estaba trabajando y ya casi a pinto de terminar mi jornada me dice mi superviso ve a la oficina quieren hablar contigo ,, llego a la oficina y comienzan a leerme una carta donde me dicen que ya no necesitan de mis servicios pregunte por que o si era temporal. Y no me dijeron que ya no me querían mis servicios que ya no me necesitaban pregunte por que me corren y dejan a gente nueva y respondieron que no existía señoría me canse de preguntarles y no me dieron ninguna explicación ,,, necesito ayuda gracias..

me corrieron de mi trabajo la razon fue por que mi caro semequedo sin gasolina a una distancia de dies millas de retirado de mi trabajo y reporto inmediatamentea la conpania ese dia no pude ir a trabajar y mepresento el siguiente dia en la manana y medan la noticia de que soy despedido por que falte un dia porfabor alguien me puede sacar de esta gran duda o alguien me puede ayudar, muchasgracias

Creo que he sido victima de despido injustificado mi esposo y yo sin tener una buena justificacion lo cual no me aclararon nada bien y sin recibir mi cheque al momento del despido y tambien en ese tiempo fuimos obligados a trabajar un dia por la ma?ana contra nuestra voluntad a unos pocos metros de una maquina que fumiga con quimicos y pesticidas toxicos siento que an sido vlolados mis derechos por un patron prepotente que no sabe tratar al personal. Me gustaria saber si me pueden ayudar Graciass....

Me corrieron del trabajo solamente por faltar un dia y NO avisarles, aunque la verdad NO se porque si Nunca falto,soy una joven muy trabajadora y responsable,necesito saber si puedo hacer algo para poder agarrar el desempleo,hace un mes que me corrieron y aun No recibo respuestas sobre el formato del desempleo y ahora NO tengo dinero
