Brain Injury Lawsuit Settlement Helps Injured Boy

Dallas, TXA tragic brain injury that left a young boy with permanent disabilities has resulted in a settlement, although the parties involved are bound by nondisclosure agreements. Nonetheless, the settlement of one brain injury lawsuit serves somewhat as closure for the family of Abdallah Khader.

As reported by PR Newswire (5/30/12), the Khader family was driving together in the family car nearly four years ago when they were struck by another vehicle driven by a man returning from an Applebee's restaurant and found to be under the influence. While all four members of the Khader family were injured in the crash, Abdallah—who was two at the time of the collision—was the most seriously injured of the four.

The toddler suffered a traumatic brain injury. His family launched a brain injury lawsuit, naming Applebee's and the driver of the other car, Stewart Lee Richardson, as defendants.

The plaintiffs alleged that Richardson had been consuming copious amounts of alcohol within a relatively short period of time at an Applebee's franchise located in Mansfield, Texas. Their TBI lawyer, as part of an investigation, reportedly unearthed a receipt from the day of the 2009 accident summarizing Richardson's consumption at the licensed restaurant. To that end, the receipt showed that Richardson was served no fewer than 23 alcoholic beverages in less than two hours.

A police investigation following the tragic brain trauma accident appears to support that finding. The release reveals Richardson had a blood-alcohol content in excess of three times the legal limit. At the time of the accident, Richardson had already racked up six prior drunk driving convictions in two different states.

Richardson, it was reported, awaits trial on related drunk driving charges.

Khader, et al. v. Richardson, et al was filed in the 116th Civil District Court, in Dallas Texas with the help of a brain injury lawyer. The brain injury lawsuit sought compensation related to the ongoing financial burden the family was under attempting to meet the physical needs of their son following his brain trauma, together with loss of earnings, emotional trauma and mental anguish, and prior medical expenses.
