AMS Transvaginal Mesh Settlement Money “Chump Change”

Tacoma, WAAndrea recently received a transvaginal mesh settlement offer from American Medical Systems (AMS), but she says it’s little more than “chump change” given the four-year nightmare she has gone through since the device was implanted, and it ain’t over yet...

For most women who have suffered adverse events from the mesh and filed a lawsuit against AMS, the company is offering $40,000. Women who’ve been more seriously injured are receiving settlements of $250,000 or more, depending upon which “tier” you fit into (your attorney can assist you).

But Andrea says she was offered only $9,000 from the “special master settlement.” “I’m not sure if I should accept this due to not having any medical insurance for years,” she says. “Consequently I’ve had the bare minimum of doctor visits, and there is nothing I want more than getting this mesh removed, but I can’t afford it.” And it is very unlikely that $9,000 would cover the costs of surgery to remove the AMS transvaginal mesh. “I went back to the doctor that did the implant, however, but he said he didn’t know why I have even worse incontinence now than pre-mesh. Every day, my bladder doesn’t empty all the way, and I have severe leakage. And he couldn’t explain why I am having so much pain, especially when I had - past tense - sex.”

Given those symptoms that Andrea has endured for four years, it is unfathomable why she was only offered $9,000.

And no amount of money can repair Andrea’s 30-year marriage. She and her husband went their separate ways a few years ago. Andrea blames most of it on their sexual problems due to the mesh. “I had a mental breakdown and along with the incontinence, I lost my job,” she says. “I had to go on disability and have to rely on my family a lot.

“I could really do with the money but if I accept, I am responsible for any medical problems - past, present and future. I still have to get this mesh out. And I would have to live with AMS not admitting to any guilt.

“I think AMS is counting on women like me to take the money and run, which is a pittance. I wish someone could help me make a decision, but right now I’m leaning toward having my day in court.”

Andrea might be better off not accepting the settlement. Juries have, for the most part, sided with plaintiffs who have suffered transvaginal mesh injuries. And they have been awarded substantial settlements. As Andrea said, $9K is chump change.

Has anyone dealt with Ford and Associates?
Every time I try to get an update, I get told we haven't resolved the matter.

Is there a way to find out if the Courts have actually settled the case that I'm part of or is it just a big waiting game, hoping to get a fair amount?

I have seen women stating that they had settlements in the amount of $ 45,000 and higher but also some that state they only received $ 7500.

I have had several surgeries and have dealt with a lot of medical issues since my original procedure was done in 2010.
Any answers would be good.

Trina I am in the same boat. I signed to settle in Sept of 2015 and have yet to receive any money. This is such a joke. Then the fact that I heard they are taking money out to pay bills. That is insane. I hate the fact that if you go to a dr and say you have mesh, it's like the can't get you out of their office fast enough.

Has anyone gotten any money? I read they had ten (10) days from the date approved by court and payment was delivered to these trust they set up. What does that mean since they didn't give me my money in almost 10 years feels like. How long do we have to wait? And since the court approved the attorneys who worked on this case fees, are we still supposed to pay our attorneys? For what? I'm thinking of complaining to the bar this is stupid to keep victims hanging when they've had the money at least since Oct if not before.

This entire ordeal has devastated my life. I signed a settlement and my attorney told me I would have my money in 30 days. Its going on 10 months now. My atty wont return my calls or emails. It doesnt take a rocket scientist to figure out I was scammed.

I have had so many problems with the mesh inplants:

Back pain, abdominal pain and bloating,the pain with sex, not to mention the stress I have with my husband...
everyday I wish I could get this removed..

I also have suffered since my surgery in April of 2014. Do they really think a settlement of 9000 is going to make this right? Seriously I have gone through multiple surgeries since then and still have a upcoming in the next month. Like losing my job of 18 years and husband that I can never get back. Thanks to AMS

I am the spouse,,well now divorced but still in the same house, it's a nightmare for her and our relationship, it's gone down the tubes.. spouses should receive compensation as well for loss of partnership..

So upset by all this, n how my life is. This mesh ruined my life my marriage, my job. My mind. Do we have to accept it? Im so confused. What are we all suppose to do. Why do we need to ne put in tiers . Thats bullcrap. Im in my 40s. I feel like sh*t, how do i know what my 50 60 n 70s n 80s will b like if i take a lousy offer below 10 grand. Wow thank u ams... u ruined my life, my marriage n my mind. Anyone agree. What is everybody doing, are u all taking it. Or are we all saying no way.

I was offered a very minimal amount. I will suffer for the rest of my life from the damages incurred. I can never have relations with my husband of 30+ years, again!I am unable to work and most of the time I'm in extreme pain.

I refused my settlement as well. Got a letter saying that AMS went ahead with the settlement even though they had less then 90 % acceptance. I am wait for the outcome of my appeal. I repeatedly asked my attorney if she will take it to trail and I get the run around. I finally told her if she didn't get a better offer I'd rather walk away with nothing before I'd see her get more money then me!! If anyone knows a firm that is not backing down and will take it to trail please give me their names. I highly doubt my lawyer will fight for me. They actually tried to have me sign a release form before I even accept a settlement stating I would not sue. They don't treat your case individually the corral you like cattle. When I filed for the appeal I went back to doctors and highlight all of the notes on my surgeries. What did they do for the two years they had my case? I went to each Dr and got all the information. Useless lawyers but damned if they don't want their 35%.

My offer for my ams mesh settlement is very low. Anyone else using attorney that turned everything over to other attorney's. I so confused about this settlement. I fill I deserve more than they offered. I have horrible leg pain but can't prove it due to my back surgeries.

4 years!!! And nothing but a headache. It hasn't been worth the process. My doctors haven't documented right so $9000 is all that's coming from this settlement, and it has taken half for lawyers fees etc. if I had it to do over again I wouldn't have bothered. I have pain and discomfort, a mesh implant that's gone wrong and I get this!!

The settlements the (TVM) cases are offering are a "slap in the face" to the pain I endured over the course of a little over a year while the mesh was implanted. People should not be so hasty to take these small pay offs and insist their case goes to trial. The lawyers who are defended us aren't working to get us the best offer. They are working to rake as much money as they can in for their firms. I refused my settlement because it was not what I believed would be a fair settlement, without the expense of going to trial. What I felt my pain and suffering was worth, which didn't include punitive damages. The law firms on both sides know what it will cost to take these cases to trial and neither side wants that, so hold out for a better offer. Don't let them take anymore than they already have..

Yes all of these (TVM) cases are trying to settle these cases for chump change. I refused the offer they made me, it will cost them hundreds of thousands of dollars to take this to trial. Does anyone think they really want to do that.

This is not Justice. Women ending up with pocket change. They have lost their lives, bodies destroyed by these Untested Toxic Mesh. No one knows what our future health will be. The Abandonment from the FDA, Congress an entire Medical Community and possibly our Judicial System....is appalling. Shame on you all. Women Lives Matter. Commerce over our lives and Safety never should of happened.
