Testimony against Takeda in Actos Lawsuit Alleges Profits Put before Patients

New York, NYA recent Actos bladder cancer lawsuit alleged that officials at Takeda Pharmaceutical Co., put profits ahead of patient safety when it came to Actos side effects. Testimony at the lawsuit, which was heard in March 2013, alleged the company was against including a bladder cancer warning on the Actos label. The Actos lawsuit resulted in a $6.5 million award to the victim, which was later overturned by the judge.

During testimony at the lawsuit, Howard Greenberg, a clinical pharmacologist, said Takeda management was concerned that officials would request the company include a warning label about the risk of bladder cancer, as evidenced by e-mails from officials. Bloomberg (3/5/13) reports Greenberg testified that one e-mail, which reportedly said, “we need to manage this issue very carefully and successfully not to cause any damage for this product globally,” admitted the e-mail may not actually speak to the company’s policy on the safety of patients.

The lawsuit (Cooper v. Takeda Pharmaceuticals America Inc., CGC-12-518535 California Superior Court, Los Angeles) resulted in a jury award of $6.5 million for the plaintiff, but a judge set aside that award, agreeing with Takeda that the plaintiff did not prove his use of Actos caused his bladder cancer. According to Cooper’s lawsuit, he was diagnosed with bladder cancer in 2011 and had taken Actos for four years.

Meanwhile, the federal Actos bladder cancer lawsuits (consolidated into Actos Product Liability Litigation, MDL No. 2299) continue to move forward. There are reportedly approximately 2,400 lawsuits pending in the MDL in Louisiana, with the first trial scheduled before the courts for January 27, 2014. The lawsuits all allege Takeda failed to adequately warn about the risk of bladder cancer associated with the use of Actos.

While litigation about Actos works its way through the courts, GlaxoSmithKline, maker of Avandia, has reportedly agreed to pay almost $230 million to eight states to settle allegations of improperly marketing its drug. Avandia was the rival drug to Actos until its use was heavily restricted by the US Food and Drug Administration (FDA) due to concerns about heart problems linked to the drug. According to Reuters (7/24/13), GlaxoSmithKline has not admitted to any wrongdoing. States involved in the settlement include Louisiana, Kentucky and New Mexico.

Its true Glaxo Smith Kline chicken out and decieded to settle the Avandia case , before something worse happened to them , however what did they loose ? ,they haven't paid those families in full ,people lost love ones over there criminal acts and had to go into debt because of there lack of honest business trade. The lawyers and the Federal Goverment are the only ones who got rich, I was told that in my case the defense has yet released the remaining funds which they should have never taken in the first place... I reminded my attorney that the Defense Lost why the hell are they calling the shots,he thought that i just wanted to fight. its not that I believe that when one breaks the law regardless of what they are they should be jailed if found guilty, or if they chicken out as Glaxo Smith Kline did they should have to pay up immediliey promises that the check is in the mail for years is unexceptable a settlement should not be changed once it is submitted
