Make Debt Collectors Pay for Harassing You

Riverview, FLIf you have debts you can’t pay and the bill collector is hounding you - don’t let them get away with it. The Fair Debt Collection Act was enacted by Congress to protect consumers from unscrupulous debt collectors that are only too willing to call you dozens of times a day, make threats to seize your property and otherwise try to harass you into paying up.

“They’re bullies,” says attorney Ben Stewart of Stewart Law PLLC. “What consumers don’t know is that they may receive financial compensation for turning in nasty bill collectors for violating the federal law.

“People also don’t know that if they contact an attorney, the law says that bill collectors have to stop contacting you because you are represented by an attorney, and it won’t cost you a thing to do that. “If you hire me because the debt collector is harassing you in violation of a federal statute, then upon success of the case, my fees are paid by the debt collector, and the client who was harassed is entitled to receive money from the debt collector,” explains Stewart.

Last year the Federal Trade Commission (FTC) received more than 100,000 calls from consumers with complaints about overzealous bill collectors. But a complaint to the FTC, although it might be a good thing to do, won’t stop the bill collector from bugging people with bad debts or get them compensation for being the target of unlawful actions.

“The law is there to protect you but you must invoke it by hiring an attorney,” says Stewart. “You have the right to file a complaint with the FTC about bill collector harassment, but that does not stop them from harassing you or get you compensation for turning them in.”

So What’s Unlawful Bill Collector Behavior

There are lots of rules for debt collectors. They can’t call you before 8:00 in the morning or after 9:00 at night. They can’t call you at work if they’re told you are not allowed to get calls at work. They must send you a “validation notice” telling you how much money you owe within five days of contacting you. They can’t use threats of violence or harm, repeatedly use the phone to annoy someone, make false statements, threaten to seize your property, or garnish your wages unless they have a court ruling, or contact you by postcard. Those are just a few of the things they can’t do.

Unscrupulous Debt Collection on the Rise

American consumers owe a lot of money. According to the experts, there is about $1 trillion in unpaid consumer debt in the US. Most of that is overdue by 90 days or more. Along with the high debt levels has come a very aggressive group of bill collectors that take advantage of the Internet and the electronic-age communication to squeeze consumers as hard as they can.

“They are definitely becoming more aggressive because of the age of personal electronics,” says Stewart. “You are more accessible to them than you used to be. They e-mail you, they US mail you, they can call you on your cell phone. The Internet makes it easier for them to find you at work and contact your employer. Then there are just more people having trouble paying their bills and there are more debt collectors out there.”
And just because you owe money doesn’t mean you don’t have rights. You may even be able to sue the debt collection agency. A woman in Texas recently filed suit against a debt collection company after one of its bill collectors called and identified himself as being from the “legal department.”

That kind of misinformation used by bill collectors to frighten people into paying is strictly against the rules.

“Don’t let them get away with these kinds of things,” says Stewart. “You don’t have to and it may pay you to turn nasty bill collectors in for their bad behavior.”

I have a bill collector that calls me everyday. Credit One calls and stays on the line and doesn't say anything at least 11 times a day One particular day the lady says hello Wanda and hangs up she called from 571-316-2506 When I called this number back it stated that this number is not in service. They call me all day and never say a word other than calling me out of my name or playing music . the numbers are 571-260-2389,571-260-2350,571-316-2506,571-316-2475. When I called them and told them that someone left a message calling me out of my name they said they would report it and playing music and just holding on to the phone not saying anything.

Somebody use my name and social security but some collector calls everyday.. Its a harrassment..

hello this Collector called me said i had taken out a payday loan in 2010 i called the company that they said i owe.The woman told me they dont have anyone by my name.So i called the collector back told her that.She said they give us the paper work we handle it-they dont have it after we get it.So after fighting with her on the phone-i told her just send me the paperwork because i DONT make payments over the phone.I want to see the bill-she said ok someone WILL be coming to your house to deliver papers for court.I said fine Good ill be bringing my attorney also.She hung up BUT they are still calling me every day and i DONT pick up.They started calling my daughter i told her block the calls she said ok mom!!!The collectors number is 844 279 7423 they also call from another number 302.Just thought id leave the number for all to see just incase they try to contact you!!!

My car loan organization had been calling now leaving certified letters starting repossession. This has been going on since November. I have recently developed shingled due to the stress of their constant contact.

What can I do?

I have my Mortgage company that calls after the first if they do not receive the check. The check is mailed before the 15th of the month. They count it as past due at that time. The will call six times a day first in the morning the first call, and a second call in about 10 minutes later. And then they call in afternoon and evening, everyday until they process the check. Which HFC holds for seven days.

Any advise?

Debt collector keep calling and calling they are very rude and keep threatened to garnish my wages and taxes i its not even my debt they wont send me the information they so called have against me i dont know what to do i keep telling thrm not to call me but they call even more its so aggravating.

I have question i just filed a complainted and sued delted for harrasseing me over old bill that avested bank turned over to them.after avested bank wrote it off on mine creidted report 4 yrs ago i think it was.i was paying delted 25 dollars month for 1 yr never missed a payment intill i sued them,and they harrassing mine husband over it to at work and he wasnt on loan.but i did win ,but few months after i won.avest bank had someone calling me seeing if i looking buy new car.then started sending me letter out.and i not sure how miny calls,who they have call me,because,i have had some miny harrseing calls,i no longer answer mine house phone or cell unless i no who it is .so is this ok is the bank suppose to contact me again or what.i fill like i shouldnt owe them nothing .since i was paying and doing mine agreement they are ones they back out of it not me. they was taken the money directly out of mine account every month intill they had that company harrasing me for no reason,so i guess bank gona start now.dont no if i can do anything or not about it thanks for looking

I get at least 10 calls a day from the same debt collector, I talked to them one time and asked if I could pay $10.00 a month on the bill and was told no it had to be more, to my understandings as long as you make an attempt to pay they had to accept, but they did not. The company continue to call everyday even the weekends, I once talked to a lady at the company and explained to her my problems and she yelled at me and told me YOU NEED TO PAY YOUR BILLS, it upset me so bad that I yelled back at her and told her, well she then called me back and would hang up on me. I have health problems and can't deal with this, this has been going on since for six months., it has gotten to a point that I know there numbers by hard., sometimes they call and don't say anything but I know and sometimes recording.

I get call,s from 7;am till 9 p;m I take care of my aunt, We get woke up at 7;am, I never do need to set the alarm clock, !! And !!! 'I never get to sleep in , I get so many call,s a day that my phone will go dead,I get up at 6;am to go get the phone to hide under my pillow & cover,s just so she can get her sleep she has to be on her machine for 10- hour,s a night, my hand,s our so full , I do not & should not have to pack my phone a round with me all day, I am so sick of all the call,s from " MACHINE!!, they even call her gov. cell phone !! only for emergency,s use , I do not know hoe they get that numb. I get so tired of picking up the phone.

I had a bill collector send someone to my home who delivered to me what looked like a lawsuit. It was not in an envelope so the person delivering it ( who looked like just some guy working for minimum wage) could read the whole thing.
I did not realize that this sort of thing may have been illegal.

I AM SO SICK AND TIRED OF THEM CALLING MY HOUSE. THEY ALREADY SCREWED MY CREDIT. THEY CALL EARLY IN THE MORNINGS, LATE AT NIGHT, EVEN ON SUNDAYS WAKING ME UP OUT OF MY SLEEP. IM PIST OFF. I WISH IT IS SOMETHING I CAN DO.

For land line phones, Panasonic offers an answering machine with the capability to block incoming numbers. This is very effective in stopping robo and bill collector calls.

Blocking a number results in one ring only but the caller gets a busy signal.

Bill collectors call two or three times a day with a "robo" calling machine (nobody is ever on the line). And the worst part is they are calling for our son who hasn't lived here in over five years. We've had this phone number for more than fourty years and I hesitate changing it, but we currently have to just use an answering machine for all incoming calls. This has been going on for over a year now and its getting pretty old that you can't even answer your own phone. These "robo" callers should be outlawed!
