Negligence on a Supervisor

This is an ERROR on the Supervisor part...(This Supervisor is me) One day at a Exporting Fish Company I had an employee of mine, who had just return from his delivery at around 3:30 P and was on the dock pulling his products for the next day delivery.

He had to go into both the chill and the frozen freezers to pull his products. I was in the office wrapping up all the invoices and billing from all my drivers who had returned from their deliveries, when around 4P I decided to call it quits.

My General Manager Al had asked if all my drivers had returned from their deliveries and I said yes, and that I was ready to leave. He than proceeded outside to make sure both freezers were locked and secured, they were. As I proceeded out the door, Al had asked if all my drivers had lefted and I said we had 1
driver left who would be wrapping up his pulls for tomarrow. Al asked "where is he?"

I said "he didn't clock out I still have his time card," we then checked all areas in the facility, my employee was no where to be found. I than was concerned because I had an employee somewhere on property.
Al had called out his name as he passed the chill freezer no response, again he called out his name as he approached the frozen freezer, he could hear a slight voice coming from the freezer, I had rushed back into the office to get the keys for the freezer to let my employee out....He was in there for 25 minutes....(He had started month and half before this incident) AS a Supervisor I DID NOT call the police or the ambulance...

BIG MISTAKE AS A SUPERVISOR!!!
Now this employee has emotional fear of inclosed area and is blaming me for his cause....

employee seek for compansation or action for this incident that happen in July of 2005.
