Merck to Pay $285,000 in Fosamax Lawsuit


This is a settlement for the Fosamax lawsuit.

New York, NY: Merck, the maker of the osteoporosis drug Fosamax, has been ordered to pay $285,000 in damages in a defective products lawsuit brought by plaintiff Rhoda Scheinberg. Scheinberg alleged that Merck failed to warn her doctors of the risks associated with Fosamax.

Scheinberg, a 69-year-old New York resident, contended Fosamax caused her to suffer delayed healing and a bone disease of the jaw after a tooth extraction. The jury found that Merck's failure to warn of the drug's risks was a cause of her injury, but did not find the product was defective, Reuters.com reported.

Filed in 2008, Scheinberg' lawsuit, Scheinberg v. Merck & Co, Inc., U.S. District Court, Southern District of New York, 09-4119, was one of 975 pending before U.S. District Judge John Keenan in New York after a judicial panel consolidated Fosamax cases alleging jaw-related injuries. Another 842 lawsuits alleging injuries to the femur are pending in New Jersey, with additional lawsuits pending in state courts.

Overall, more than 4,000 Fosamax lawsuits are pending in federal and state courts alleging injuries caused by the medication.
