Patient Awarded $5M in Medical Malpractice Lawsuit

Franklin County, OH: A medical malpractice lawsuit brought against anesthesiologist, David Leak, M.D., by a patient who alleged he was left paralyzed as a result of Leak's actions, was settled for $5M.

The suit alleged that the anesthesiologist failed to properly plae an epidural injection in patient Karen Baugh-Ross, who consequently suffered permanent, partial paralysis of her bowel and bladder functions, as well as club foot. Baugh-Ross alleged that Leak injected Lidocaine or Morcaine directly into her artery, which she argued was a violation in the standard of care. Leak did not present a defense.
