Cyclist Hit by Bus Awarded $5.36MSan Francisco, CA: In 2008, David Wheeler was involved in a bicycle accident which left him with permanent brain damage. Just 47-years old at the time, Wheeler was riding across the Lower Great Highway in San Francisco at night, when he was struck by a bus.In his suit, Wheeler alleged that the bus, operated by Roy Timmons, had made a left turn without signaling or stopping at a stop sign and then struck him. Wheeler was thrown from his bike, hitting his head on the asphalt, and as a result sustained traumatic brain injuries, such that he now has the mental capacity of a child. The defense arged that Wheeler was not wearing a helmet at the time of the accident, nor did his bike have a headlight, which is in violation of state law. However, videotape from a survellience camera showed that Timmons had failed to stop at the intersection. As a result, the jury awarded Wheeler a $5.36 million settlement.
