Jury Awards $30.7M Settlement for Pond Drowning

New York, NY: The family of a small boy who drowned in a pond while trying to save his younger brother who had also fallen in the pond have been awarded a $30.7M settlement by the jury hearing their premises liability lawsuit.

In 2001, Andrew Kennedy, who was just 11 years old, tried to save his 10-year old brother James, who had fallen through the ice. Andrew drowned and James suffered severe brain damage. Christopher Kennedy, who is Andrew's twin, claimed emotional and psychological trauma from witnessing the incident. Their parents claimed the property owner, Lakes of the Four Seasons Property Owners Association Inc., failed to place warning signs or restrict access to the area. They also claimed it failed to provide safety devices nearby.

The defendants argued that the event was an unanticipated natural ooccurrence and the parents bore some liability for the incident.
